Local Licensing Authority <br />Minutes <br />August 27, 2012 <br />Page 5 of 6 <br />on the application. <br />Attorney Culley outlined the options for the Authority members. The <br />temporary license could be extended for 60 more days and the Authority <br />could approve the license contingent on the applicant providing the needed <br />items. <br />Carlson moved to approve the license contingent on providing the City <br />Clerk's office the needed items and to extend the temporary license 60 days. <br />Seconded by Lipton. All in favor. <br />Police Department Reports <br />A. Incident Report — 7/29/12 — Ralphie's <br />This incident involved officers responding to possible liquor violations related <br />to a DUI stop. Another patron of the establishment observed the party drive <br />away and reported a partial license plate number to the police leading to the <br />stop. Discussion centered on whether or not a show cause hearing was <br />warranted. <br />Wilson moved a show cause hearing be ordered with the following cited: <br />1 - C.R.S. § 12-47-901(1)(a), stating in pertinent part that it is unlawful for any <br />person to "sell, serve, give away, dispose of, exchange, or deliver or permit the <br />sale, serving, giving, or procuring of any alcoholic beverage to a visibly <br />intoxicated person or to a known habitual drunkard." <br />2 - Colorado Code of Regulations, Regulations Relating to Alcohol Beverages § <br />47-900.A, stating in pertinent part that the licensee as well as any employee or <br />agent of licensee "shall conduct the licensed premises in a decent, orderly and <br />respectable manner, and shall not serve a known habitual drunkard or any <br />person who displays any visible signs of intoxication, nor shall they permit a <br />known habitual drunkard or any person who displays any visible signs of <br />intoxication to remain on the premises without an acceptable purpose ...." <br />3 - Louisville Municipal Code § 9.22.060, stating in pertinent part that no person <br />"shall sell, serve, give away, dispose of, exchange or deliver, or permit the sale, <br />serving, giving away or procuring of, any alcohol beverages, as defined in section <br />9.22.010, ... to a visibly intoxicated person, or a known habitual drunkard." <br />Rommelfanger seconded. Wilson amended the motion to add; direct staff to <br />appoint a special prosecutor and set the show cause hearing for the next <br />Authority meeting, September 24, 2012 at 7:00 p.m. Rommelfanger accepted <br />the amendment. All in favor. Show cause ordered. <br />B. Incident Report — 8/4/12 — Ralphie's <br />Police investigated a report of a party leaving without paying. Authority <br />members agreed no further action was required on this report. <br />
