He felt that it added <br />flexibility to both issues to be addressed at the PUD process. <br /> <br />Brown voiced his agreement with an amendment of that nature suggested by Mr. Forman. <br /> <br />For clarity, City Attorney Light restated the amendment to the second sentence of Section <br />16.c as follows: "The parties generally intend that, unless otherwise determined in the <br />PUD process, one access will be located of West Walnut Lane, and shall be a public cul- <br />de-sac extension from West Walnut Street serving no more that five (5) lots within the <br />Property" and to the fourth sentence of Section 16.c to read as follows: "The parties <br />generally intend, that unless otherwise determined in the PUD process, the private drive <br />shall connect to West Spruce Lane on the west side of the Fischer homestead as generally <br />depicted on the concept plan attached hereto as Exhibit C and incorporated herein by <br />reference." <br /> <br />Light noted that the applicant is suggesting that the same phrase be added to 16.d, the <br />fourth sentence, as follows: "The parties generally intend, that unless otherwise <br />determined in the PUD process, the majority of such open space shall be located on the <br />west side of the property, as depicted on Exhibit C." <br /> <br />Light stated that the applicant's suggested change would allow more flexibility in <br />locating the open space in the PUD process. He noted for the record that it does not <br />change the open space dedication. <br /> <br />Brown accepted the applicant's proposed change as a friendly amendment. Levihn <br />accepted the amendment. <br /> <br />Light suggested that the language of 16.e of the agreement remain as written. <br /> <br />VOTE ON THE MOTION: Roll call vote was taken. The motion passed by a vote of <br />4-1. Mayer voted no.
