City Council <br /> Meeting Minutes <br /> October 2, 2012 <br /> Page 11 of 13 <br /> City Attorney Light explained the two items before Council are the Intergovernmental <br /> Agreement concerning the design and construction of a pipeline from Hecla Lake to the <br /> Harney/Lastoka Open Space and Ordinance No. 1624, Series 2012, which vacates and <br /> abandons the City's interest in an existing private lateral off the Davidson Highline <br /> Lateral Ditch, located within the City of Louisville. <br /> Mayor Muckle requested a staff presentation. <br /> Public Works Director Kowar explained the City of Louisville, Boulder County, and the <br /> City of Lafayette are partners in the South Boulder Road Open Space Purchase <br /> Intergovernmental Agreement. Through this agreement, they purchased the property <br /> known as the Harney-Lastoka Open Space and in 2004 approved an Open Space <br /> Management Plan for the property, which discussed future options for agricultural uses <br /> on the property. The study recommended a pipeline from Hecla Lake to the north <br /> section of the Harney-Lastoka Open Space property. <br /> The Steel Ranch South Developer, RMCS, owns a portion of the private lateral, which <br /> runs through their property and serves the open space property. RMCS has offered a <br /> $100,000 challenge grant for construction of the pipeline in order to remove the impacts <br /> of the existing private lateral from their property. Louisville would pay 25%, Lafayette <br /> 25%, and Boulder County 50%, with a $350,000 project limit. This cost share will <br /> incorporate the $100,000 challenge grant for the project with the Participants agreeing <br /> to fund the remaining $250,000. The City of Louisville's contribution for this proposed <br /> intergovernmental agreement and associated pipeline project is $62,500. <br /> Staff recommended approving the proposed Ordinance No. 1624, Series 2012, to <br /> provide for vacation and abandonment of the existing private lateral along the full length <br /> of its existing alignment and approval of the proposed Intergovernmental Agreement <br /> between the City of Louisville, County of Boulder, and City of Lafayette Concerning the <br /> Design and Construction of a Pipeline from Hecla Lake to Harney/Lastoka Open Space. <br /> COUNCIL COMMENTS <br /> Council member Keany asked if this is a separate ditch from the Davidson Lateral and if <br /> the City still can still access the water. Public Works Director Kowar explained this <br /> private lateral is the only way to get water to the Hamey/Lastoka Open Space. By <br /> vacating the lateral and building the pipeline, the City cannot access the water until the <br /> next irrigation season in June. The goal is to complete the pipeline by June and <br /> coordinate with the North End Development construction before the next irrigation <br /> season. <br /> Council member Loo felt it was a very creative proposal. <br />
