Local Licensing Authority <br />Minutes <br />September24, 2012 <br />Page 4of 4 <br />about the Authority was a good sign they are doing a great job. Council <br />appreciatedthe way the Authority and Police Department work together. <br />Hanson echoed the thanks to all the Authority members for theirtime and effort. <br />Lipton thanked Secretary Hanson for having all the materials ready for the <br />presentation to Councilat the Study Session. <br />Authority Attorney’s Report <br />Authority Attorney Culley had no report. <br />Authority Comment <br />Rommelfanger reported La Buena Vida seemed to be closed. Hanson reported <br />Imperial Fez had closed. <br />Machado questioned whether the issue with Ralphie’sof not providing a receipt <br />immediately, had any legal implication. Sergeant Lanphere and Authority <br />Attorney Culley agreed there was not an issue as long as it was provided. <br />Machado inquired about the burden of proof. Authority Attorney Culley <br />responded to issue a show cause order, there must be reasonable cause. It is <br />then the City’s duty to prove theliquor code violation with apreponderance of the <br />evidence. <br />Sergeant Lanphere pointed out since the criminal burden of proof was different <br />than the civil burden in a show cause hearing, the Authority members don’t <br />always need to depend on whether or not a summons had been issued. <br />Sergeant Lanphere mentioned he and Officer Redard attended a seminar in <br />Greeley concerning Entertainment Districts and told the Authority members it <br />might be an issue they would have to review in the future. <br />Adjourn <br />–Rommelfangermoved to adjourn. Machado seconded.
