<br />RESOLUTION NO. 51 <br />SERIES 1995 <br /> <br />A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT <br />AND A FINAL PUD DEVELOPMENT PLAN FOR <br />THE HOME DEPOT <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by The Home Depot <br />a request for approval of a Final Subdivision Plat and a Final PUD Development Plan for The <br />Home Depot Subdivision; and <br /> <br />WHEREAS, all materials related to the Final Subdivision Plat and Final PUD <br />Development Plan have been reviewed by City Staff and the Planning Commission and found to <br />be in compliance with the Louisville zoning ordinances, and subdivision regulations; and <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Final Subdivision <br />Plat and Final PUD Development Plan, the Planning Commission recommended to the City <br />Council approval with conditions; and <br /> <br />WHEREAS, the City Council finds that said Final Subdivision Plat and Final PUD <br />Development Plan for The Home Depot should be approved subject to the following conditions: <br /> <br />1. The off-site landscape plan shall be approved, as a separate <br />agreement, by Council action prior to the issuance of a building <br />permit, whose cost shall not reflect less than $186,868 as lower <br />limit and $250,000 as an upper limit; <br /> <br />2. The Final PUD shall be amended to reflect an open and unrestricted <br />shared access with Colony Square along the south property line. The <br />applicant shall work with the Fire District to secure final design <br />approval for the access point prior to the issuance of a building permit; <br /> <br />3. The PUD shall be revised to reflect lighting standards (location, type, <br />number, height and power) as represented on the photometric plan. <br />The photometric plan shall be incorporated into the PUD document; <br /> <br />4. Tree calipers for all parking lot trees shall be increased to 3" inches; <br />
