Louisville City Council Meeting <br />April 3, 2001 <br />Page 14 <br /> <br />Davidson stated that it would be in the applicant's best interest if the matter was tabled <br />until May 15, 2001. <br /> <br />VOTE ON THE MOTION TO CONTINUE: All in favor. <br /> <br />COAL CREEK GOLF COURSE AGREEMENT AMENDMENT <br /> <br />City Administrator Bill Simmons reviewed the proposal to amend the Coal Creek Golf <br />Course Agreement. He reviewed that, effective March 1, 2001, the Coal Creek Golf <br />Course has been managed by Western Golf. Under the terms of the agreement, the City <br />of Louisville was established as the applicant for the liquor license. Simmons explained <br />that, in order to obtain a liquor license, the Colorado Department Liquor Enforcement <br />Division has requested that the City of Louisville hold all the licenses for the Golf <br />Course, including the food service license, sales tax license, business licenses. This <br />amendment to the agreement requires the City to acquire all of the licenses, and said <br />licenses be the sole property of the City. Additionally, the amendment further stipulates <br />that any adverse actions, suspensions, or revocations of the food service or liquor license <br />is cause for a default under the terms of the management agreement. He noted that the <br />temporary liquor license will expire soon and asked for Council approval. <br /> <br />City Attorney Light stated that his office has been in correspondence with the Colorado <br />Department of Revenue Liquor Enforcement Division with respect to the liquor license. <br />Light noted that they have concluded that the City of Louisville should hold all the <br />licenses or be co-licensees with Western Golf. <br /> <br />Davidson asked for Council questions or comments with respect to the amendments to <br />the Coal Creek Golf Course Agreement. <br /> <br />Sisk asked City Administrator Simmons if Western Golf will procure the licenses on <br />behalf of the City. Simmons confirmed they would and that the cost of the licenses would <br />come out of the Golf Course Fund as they normally would. <br /> <br />Mayer asked City Attorney Light if the City will have any additional liability by holding <br />all the licenses. <br /> <br />Light stated that the City will become the licensee on all of the licenses. The City issues <br />two of the licenses, the sales tax and the business license. He stated that the licenses, <br />which create risk, are the health and the liquor license. He stated that the Agreement <br />stipulates that WGP will be in default of the Agreement if any act on their part puts those <br />licenses at risk. Light noted that the City will hold the management company responsible <br />for operating in compliance with the licenses. <br /> <br />14 <br /> <br /> <br />
