The board of adjustment shall not allow deviations from the <br /> boundary line as mapped unless the evidence clearly and conclusively establishes that the <br /> mapped location of the lines is incorrect. <br /> B. The board of adjustment shall render a written opinion within 30 days following the <br /> last day of such hearing setting forth its findings of fact and the reasons for its decision. <br /> C. Those aggrieved by the decision of the board of adjustment, may appeal such decision <br /> to the district court of the county, as provided in Rule 106(a)(4) of the state rules of civil <br /> procedure. <br /> Sec. 17.56.200. - Floodplain development permit for all land uses within the flood <br /> regulatory district. <br /> A floodplain development permit is required and must be obtained from the board of adjustment <br /> before any new land use, construction, or development begins within the flood regulatory district <br /> or area of special flood hazard. <br /> Sec. 17.56.210.- Floodplain development permit—Procedure. <br /> A. Establishment of development permit. A floodplain development permit shall be obtained <br /> before construction or development begins within any area of the flood regulatory district <br /> established by this chapter. Application for a floodplain development permit shall be made on <br /> forms furnished by the director and may include, but not be limited to: plans in duplicate drawn <br /> to scale showing the nature, location, dimensions, and elevations of the area in question; existing <br /> or proposed structures, fill, storage of materials, drainage facilities, including the placement of <br /> manufactured homes; and the location of the foregoing in relation to the Special Flood Hazard <br /> Area. Specifically, the following information is required: <br /> 1. Elevation in relation to mean sea level of the lowest floor (including basement) of all <br /> structures; <br /> 2. Elevation in relation to mean sea level to which any nonresidential structure has been <br /> floodproofed; <br /> 3. Certification by a Colorado registered professional engineer or architect that the <br /> floodproofing methods for any nonresidential structure meet the floodproofing standards <br /> and practices specified in section 17.56.250; and <br /> 4. Description of the extent to which any watercourse will be altered or relocated as a <br /> result of proposed development. <br /> B. Administration and implementation authority.
