<br />DENIED 7/18/95 <br /> <br />AMENDED <br />RESOLUTION NO. 31 <br />SERIES 1995 <br /> <br />A RESOLUTION APPROVING A <br />FINAL PUD DEVELOPMENT PLAN OF <br />CENTENNIAL VALLEY, PARCEL 'H', LOT 3, <br />HOMESTEAD VILLAGE EFFICIENCIES <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by Property Trust <br />of America, for a Homestead Village Efficiencies, a Final PUD Development Plan of Centennial <br />Valley, Parcel'H', Lot 3; and <br /> <br />WHEREAS, all materials related to the Final PUD Development Plan have been reviewed <br />in conjunction with the Louisville zoning ordinances, subdivision regulations, and related policies; <br />and, <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Final PUD <br />Development Plan the Planning Commission recommended approval to the City Council with <br />conditions of approval; and, <br /> <br />WHEREAS, said Final PUD Development Plan proposes construction of an extended stay <br />lodging facility with cooking facilities on Lot 3; and, <br /> <br />WHEREAS, the general plan of the Planned Community Zone District (PCZD) applicable <br />to Lot 3 designates the uses permitted on Lot 3 as commercial; and, <br /> <br />WHEREAS, pursuant to the Louisville Municipal Code, Section 17.72.090, an extended <br />stay lodging facility with cooking facilities is not a use-by-right in a "commercial" designation of <br />a PCZD general plan; and, <br /> <br />WHEREAS, Louisville Municipal code, Section 17. 72.090.B.19 allows the City Council <br />to permit other uses in such commercial designation of a PCZD general plan if the City Council <br />finds such other uses "to be specifically compatible for commercial and office planning areas"; <br />and, <br /> <br />WHEREAS, the City Council finds that the proposed extended stay lodging facility on Lot <br />3 is specifically compatible for commercial and office planning areas, so long as there is <br />compliance with the requirements imposed on such facility in the note to the PUD Development <br />Plan for Homestead Village Efficiencies; and <br />
