The following persons
were present -

City Council Present:

Mayor Chuck Sisk, Don Brown, Dave Clabots, Jay
Keany, Sheri Marsella, and Michele Van Pelt

City Council Absent:

Arnie Levihn

Staff Present:

Heather Balser, Asst. City Manager for Govt. Relations
Julie Boyd, Deputy City Manager
Bill Simmons, City Manager

Review - Comcast Draft Needs Assessment
Ken Fellman addressed the Council with a preview of what the draft Comcast
Needs Assessment says, noting that when it is finalized it will form the basis of
the franchise negotiation between the City and Comcast. The draft report is
available in full on the City's web site and with the City Council agenda and
packet at the library. The final report will be presented to the City Council for
adoption at its May 17 regular meeting, with a public hearing for comments. The
negotiation of the franchise agreement with Comcast will be done in Executive
Session, as permitted by the open records laws and Louisville's Home Rule
Charter.

The draft report includes a summary of key provisions that are in the current
franchise, noting that some of those items can not be included in a new franchise
due to changes in the law. Generally, there were not a lot of complaints about
service, most likely due to the recent upgrade of the system. The City has no
legal authority to control rates or "bundling" of services, the primary complaint.
The discussion of PEG fees and the provision of a production studio are
expected to be major discussion topics of discussion during the franchise
negotiation. Mr. Fellman noted that although the studio was a provision of the
previous franchise agreement, it can not be required in the new franchise. He
also clarified that the PEG fee can not be used to fund operational costs of
broadcasting, just for capital and equipment expenses.

City Council
303.335.4533 (phone)

City of Louisville
749 Main Street
303.335.4550 (fax)

Louisville CO 80027
www.ci.louisville.co.us
