The following persons <br />were present - <br /> <br />City Council Present: <br /> <br />Mayor Chuck Sisk, Don Brown, Dave Clabots, Jay <br />Keany, Sheri Marsella, and Michele Van Pelt <br /> <br />City Council Absent: <br /> <br />Arnie Levihn <br /> <br />Staff Present: <br /> <br />Heather Balser, Asst. City Manager for Govt. Relations <br />Julie Boyd, Deputy City Manager <br />Bill Simmons, City Manager <br /> <br />Review - Comcast Draft Needs Assessment <br />Ken Fellman addressed the Council with a preview of what the draft Comcast <br />Needs Assessment says, noting that when it is finalized it will form the basis of <br />the franchise negotiation between the City and Comcast. The draft report is <br />available in full on the City's web site and with the City Council agenda and <br />packet at the library. The final report will be presented to the City Council for <br />adoption at its May 17 regular meeting, with a public hearing for comments. The <br />negotiation of the franchise agreement with Comcast will be done in Executive <br />Session, as permitted by the open records laws and Louisville's Home Rule <br />Charter. <br /> <br />The draft report includes a summary of key provisions that are in the current <br />franchise, noting that some of those items can not be included in a new franchise <br />due to changes in the law. Generally, there were not a lot of complaints about <br />service, most likely due to the recent upgrade of the system. The City has no <br />legal authority to control rates or "bundling" of services, the primary complaint. <br />The discussion of PEG fees and the provision of a production studio are <br />expected to be major discussion topics of discussion during the franchise <br />negotiation. Mr. Fellman noted that although the studio was a provision of the <br />previous franchise agreement, it can not be required in the new franchise.
