Louisville City Council Meeting
May 22, 2001
Page 4
covers the documents that you've got in your packet, again, the one change to the
resolution you have would be to add a final sentence concerning pole number 39. The
attorneys for Public Service Company are here. It's my understanding that if consensus is
reached on this approach, they will sign the settlement agreement this evening and leave
a copy with the City, allowing the City to review and execute that and make the necessary
finals tomorrow to have the lawsuit dismissed. I'm available to answer any questions you
might have or add any additional background information.

Davidson called for public comments.

Carrie DeGraw, 741 Orchard Drive, Louisville, stated her comments are in regard to pole
number 39. She explained that when she arrived home from work today, she noticed a
cluster of neighbors at the end of Pear Court. They were discussing the position of the
pole that had been placed earlier in the day. The pole was placed about fifteen feet to the
south of the existing pole. This increased visibility of the pole for the four properties to
the north. She stated that, in fairness, she agreed with her neighbors that the pole should
be moved to the north, even though, if left in its current location, the pole would not be
visible from her backyard. She continued to explain that Public Service is now in the
process of removing the pole. She stated that her understanding was that the replacement
poles were to be placed within five feet of the existing poles and she asked that Council
require Public Service to adhere to this restriction, to prevent impact to homes that were
not previously impacted by the poles o She spoke with Michael Diehl, Public Service
Company, and he explained that it would be difficult to place the new poles where the
previous poles were located due to the crane being used. She stated that, in fairness to the
neighbors and to prevent pitting neighbor against neighbor, the pole needs to go as close
to the existing pole as possible.

Tom Hanson, 755 Pear Court, Louisville, explained that when he arrived home today, he
noticed that the pole was located approximately fifteen feet to the south of the previous
pole location. This creates greater visibility for some of the neighbors; however, he
expressed concern for moving the pole any great distance to the north. He explained that
the ideal location would be to place the new pole exactly where the previous pole was
located. He stated that this would be the most practical and fair resolution. He spoke with
Michael Diehl, Public Service, earlier today and Mr. Diehl stated that he thought they
could place the pole fairly close to the existing pole.

Michael Reis, 738 Pear Court, Louisville, expressed dismay that the power poles have
created controversy in a normally pleasant neighborhood. He presented photographs of
pole number 39 in its new location, which visually impacts a number of his neighbors. He
thanked City staff for their assistance in contacting Mayor Davidson and for the Mayor's
willingness to appear on the site within a short period of time after he was contacted. He
explained that the pole was removed from the location approximately 30 minutes ago.
The question remains of where to place the pole. He requested that the pole be placed as
close to the existing structure as possible, and expressed willingness to serve on a
committee to have the poles buried, as they are eyesores. He thanked everyone involved

4
