Louisville City Council Meeting
May 22, 2001
Page 5
in removing the pole from its location and encouraged Public Service to place the pole as
close to the existing structure as possible.

Rick Toray, 746 Pear Court, Louisville, asked Council to consider three things:
expectations, status quo and impact. He explained that he might have had incorrect
expectations when he moved into the neighborhood, which was that there were not going
to be other, bigger poles going in. He stated that when you move into a neighborhood,
you expect poles to be where they are, and if the poles are replaced, the replacements
should be in a similar location so that they don't impact different neighbors than the
previous poles. Secondly, he explained that you expect a certain status quo, specifically,
that the poles will either remain where they are or be removed entirely. Lastly, you must
consider the impact to the neighborhood. He stated that the current pole location
immensely impacts the view that he had prior to the new pole number 39 installed this
afternoon. He guessed that moving the pole slightly north would not have the impact on
those neighbors that the current location does.

Davidson called for Xcel Energy's presentation.

Michael Diehl, Xcel Energy, 550 15th Street, Denver, explained that he was just at the site
where pole number 39 was located. He stated that there appears to be a difference of
opinion on whether the new structure was most appropriately located on the south side or
the north side of the existing structure. He explained that, after an on-site meeting with
the Mayor and neighboring homeowners, Public Service decided in the spirit of
cooperation to pull the newly installed pole and to locate it on the north side of the
existing structure. He continued that, even now, there is a difference of opinion from
residents relative to whether that was a wise move. He explained that all but four
structures are set and stated that 'it is time to let it go, allow us to proceed'. He stated that
an employee of Public Service lost most of his ring finger during the removal of structure
39 this evening. Diehl stated that he is sorry to see it come to this.

The Mayor called for additional public comments.

Jodi Raikes, 733 Orchard Drive, Louisville, thanked the Mayor and Xcel Energy for
meeting with the neighbors today and for moving the pole. She agreed that everyone has
their opinion on where they would like the pole to be, however, the only fair thing would
be to place the pole as close to the existing pole as it can be.

Davidson called for Council comments and questions.

Sisk asked whether pole # 39 could be placed within five feet of its existing location.

Michael Diehl stated that without engineering details, he could not commit to the fact that
Xcel can locate the new structure within five feet of the existing structure. He explained
that the stake referred to by Mayor Davidson was a guide stake, which was located
somewhere between five and ten feet from the existing structure. That was the location
that the engineer, off the top of his head, indicated that we might be able to locate the
