Louisville City Council Meeting <br />June 19, 2001 <br />Page 7 <br /> <br />Mayer commented that the City just completed road improvements to that area and <br />compensation should be made. He referred to Resolution No. 36, a Council policy, <br />which stipulates the zoning is to be at the lowest density adjacent to the neighborhood. <br />Mayer concurred with Councilman Sisk that the applicant would have to justify the <br />requested zoning. <br /> <br />Hurley stated that the road improvements on Spruce Street are not complete as required <br />by the state standards, and that the applicant would be responsible bringing the street into <br />compliance. He also stated that the City would be compensated for the improvements <br />made. <br /> <br />Davidson agreed that the applicant would have to justify the zoning and suggested that <br />the applicant review Resolution No. 36. He questioned whether the bike path could be <br />considered desirable open space dedication. <br /> <br />MOTION: Brown moved that Council approve Resolution No. 28, Series 2001, and set a <br />public hearing for August 7, 2001, seconded by Mayer. All in favor. <br /> <br />APPROVAL OF BOULDER VALLEY SCHOOL DISTRICT LOUISVILLE <br />ELEMENTARY SCHOOL INTERGOVERNMENTAL AGREEMENT <br /> <br />Davidson called for Staff presentation. <br /> <br />Parks and Recreation Director Steve Baysinger, reported that through the Residential Use <br />Tax, the City of Louisville contributed $535,000 toward the construction of the Arnold <br />Levihn Gymnasium at Louisville Elementary School (LES), to increase the size of the <br />gymnasium and stage as well as upgrade the quality of those areas. In conjunction with <br />the City's contribution, the Boulder Valley School District (B¥SD) and the City have <br />developed an intergovernmental agreement, which outlines the City' s usage of the <br />gymnasium after school hours. The agreement is similar to the Fireside Elementary <br />School IGA under which the City is already operating. Baysinger reviewed the <br />provisions of the LES agreement: <br /> 1) Have priority in scheduling the gymnasium usage outside of school functions. <br />2) Pay no rental fee in conjunction with gym usage other than agreed upon <br /> maintenance fees. <br />3) Operate for 10 years under the agreement, plus an automatic 10-year renewal~ for <br /> a total of 20 years, unless either party provides written notice to the other at least <br /> 90 days prior to expiration. <br />4) Be reimbursed, on a pro-rated basis, subject to appropriation, if the agreement is <br /> terminated. <br /> <br />Baysinger reported that the City has already begun usage of the gymnasium for the winter <br />months for youth basketball, and noted that Staff has established a good working <br /> <br /> <br />
