He stated that any of those actions would <br />terminate the annexation process. He stated that he would evaluate the state statute and <br />further advise the Council. <br /> <br />Mayer voiced his opinion that the Council could simply deny Ordinance No. 1363, Series <br />2001, as legislative discretion. <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 5-1. Mayer voted no. <br /> <br />RESOLUTION NO. 31, SERIES 2001 - A RESOLUTION APPROVING AN <br />AMENDED FINAL PUD DEVELOPMENT PLAN TO MODIFY LOT <br />COVERAGE REQUIREMENTS FOR A PORTION OF THE CEDARWOOD <br />PARK SUBDIVISION <br /> <br />Davidson called for Staff presentation. <br /> <br />Wood reviewed the background information on the Cedar Park Subdivision. He noted <br />that originally it was approved as both a plat and PUD in 1979 for a total of 45 units. <br />Some of the units were approved for duplexes up to four-plexes. In 1982, both plat and <br />PUD were amended to authorize the townhouse development, which did not change the <br />overall density with a total of 45 units. The 2,000 SF limitation on lot coverage for the <br />single-family detached lots existed from the original 1979 approval. Staff has not <br />determined the source for the lot coverage restriction, which for 19 of the 22 lots is <br />effectively more restrictive than the underlying zoning requirement, which would be 30 <br />percent of lot area. Wood stated that the City Attorney reviewed the request to verify that <br />the City did not need to obtain written authorization from some or all of the property <br />owners within the subdivision/PUD. <br /> <br />Wood reviewed that the applicants, Ian and Barbara Edwards, owners/residents of 615 <br />West Street in Cedarwood Park Subdivision, have requested an amendment to the <br />existing PUD for a portion of their subdivision. The amendment would modify the <br />maximum lot coverage requirement from a flat 2,000 square to a standard of 30 percent <br />of lot area or 2,000 SF, whichever is greater. The change is requested for the single- <br />family detached lots within the subdivision. Wood explained that the Cedarwood Park <br />subdivision also includes the Cedarwood Park townhouse development along West Street <br />and the large single-family lot along Hutchison Street, which is deed restricted to a single <br />unit as part of the subdivision/PUD approval. <br /> <br />Wood reported that the request was based on the denial of their variance request. The <br />Board of Adjustment found, in part, that the request was not unique, given that the 2,000 <br />SF standard applies to many lots. In order for a variance to be granted, one of the six <br />mandatory criteria to be met requires that the circumstances surrounding the variance <br />request be unique to a single lot, not general to a neighborhood.
