<br />Louisville Local Licensing Authority <br />Meeting Date: January 24, 2005 <br />Page 6 of 7 <br /> <br />E. Show Cause Hearings - Celtic Way, L TD d/b/a Druids Arms - Tavern <br />License - 809 Main Street <br /> <br />Mark Shapiro, special prosecutor for the Local Licensing Authority and Michael <br />Rennich, attorney for Druids Arms entered their names for the record. Mr. Shapiro <br />reported there were two violations brought before the Authority for show cause <br />hearings. The first incident was service to underage drinker and the second for serving <br />to a visibly intoxicated person. The stipulation reached was the licensee agreed to the <br />charges in the first case and dropping the second case. Mr. Shapiro further explained <br />how they had come to the agreement. The agreement would be 3 days served <br />(includes 2 held in abeyance from a previous violation) and 2 days held in abeyance. <br />Mr. Rennich commented on the change of management at Druids. The son of the <br />owners had taken over for a time and then those owners took the tavern back. He felt <br />with the circumstances involved in these cases, this was an appropriate stipulation. <br /> <br />Authority discussion centered on the history of this establishment and proper penalty for <br />a second offense. Member Lipton moved to deny the stipulation and agreement. Paige <br />seconded. Roll Call Vote: Koertje - yes, Paige - yes, Mulvahill - no, Lipton - yes and <br />Wilson - yes. Motion carried. <br /> <br />Lipton moved to continue the show cause hearing to the February 28, 2005 meeting <br />and for it to begin at 6:30 p.m. Wilson seconded. Roll Call Vote: Wilson - yes, Lipton- <br />yes, Mulvahill- yes, Paige - yes and Koertje - yes. Motion carried. <br /> <br />G. Show Cause Hearing - Silco Oil Co. d/b/a Barn Store 21 - 3.2% Beer <br />License - 947 Pine Street <br /> <br />Stefan Fredricksmeyer, attorney for the Local Licensing Authority introduced himself <br />and Gary Grabianowski, Area Manager for Silco Oil Company. Mr. Fredricksmeyer <br />presented the stipulation and agreement he had drafted with Mr. Grabianowski. <br /> <br />Lipton moved to accept the stipulation and agreement. Mulvahill seconded. Roll Call <br />Vote: Mulvahill - yes, Lipton - yes, Wilson - yes, Paige - yes and Koertje - yes. <br />Motion carried. <br /> <br />Mr. Fredricksmeyer then presented a petition for permission to pay a fine in lieu of <br />suspension worked out with Mr. Grabianowski. <br /> <br />Mulvahill moved the Authority grant the licensee's request to serve the 1-day <br />suspension by paying a fine in lieu of suspension and setting the fine amount at the <br />minimum of $200.00 based on the receipts presented by Mr. Grabianowski. Wilson <br />seconded. Roll Call Vote: Lipton - yes, Mulvahill - yes, Wilson - yes, Koertje - yes <br />and Paige - yes.
