INTERGOVERNMENTAL AGREEMENT <br /> THIS INTERGOVJRNMENTAL AGREEMENT ("Agreement"), dated and effective as <br /> of this ]I day of ,°tA�/tiA/ , 2013 is entered into by and between the undersigned <br /> political subdivisions of the Statiof Colorado (hereinafter collectively called "Members" or the <br /> "parties"). <br /> WHEREAS, the parties share similar concerns and objectives with respect to establishing <br /> a baseline of access and use of broadband Internet services at affordable pricing for Colorado <br /> schools, libraries, and other Community Anchors; and <br /> WHEREAS, the parties have concluded that the current availability and affordability of <br /> high-speed broadband access for Colorado's schools, libraries and Community Anchors is <br /> inadequate; and <br /> WHEREAS, the parties have concluded that high-speed broadband access and services <br /> are vital to the success of Colorado students and for Colorado's economic growth, global <br /> competitiveness, innovation, and education of its population; and <br /> WHEREAS. after extensive study the parties have determined that by working together, <br /> Middle Mile high-speed broadband connectivity to schools, libraries and other Community <br /> Anchor locations can be provided in a manner which will also facilitate non-discriminate access <br /> for local Last Mile broadband providers, thereby improving their Last Mile broadband service <br /> offerings for residential and business customers; and <br /> WHEREAS, the sharing of resources and information, and the cooperation in providing <br /> broadband services to schools, libraries and Community Anchor locations would benefit the <br /> citizens of Colorado; and <br /> WHEREAS, by participating as a party to this Intergovernmental Agreement, each <br /> individual Member can avail itself of the broadband benefits that the EAGLE-Net project will <br /> offer to Members; and <br /> WHEREAS, through the intergovernmental agency created by this Agreement, the parties <br /> desire to coordinate and cooperate in the administration, monitoring, and deployment of <br /> broadband services; to research and study broadband service matters; and on an ongoing basis to <br /> address common concerns, investigate mutual solutions to challenges, and new means of <br /> EAGLE-Net <br /> Intergovernmental Agreement <br /> Revised 1/17/12 <br /> Page 1 <br />
