<br />Local Licensing Authority <br />Minutes <br />October 24, 2005 <br />Page 3 of 3 <br />on failure to pay taxes as specified by the City and their report to be prepared by <br />the Sales Tax Division, to set the hearing date for November 28,2005 at <br />7:00 PM and to have the Authority Attorney appoint a special prosecutor. <br />Attorney Light offered a friendly amendment to include a finding of sufficient <br />probable cause to proceed on the show cause order based on the information <br />provided by the Finance Department to the Authority Secretary and reported to <br />the Authority, that is the failure to pay the July taxes and the show cause not be <br />concerning taxes per se, but the record of the licensee. Wilson accepted the <br />amendment to the motion. Rommelfanger seconded. Roll Call Vote: Koertje- <br />yes, Mulvahill - yes, Wilson - yes, Rommelfanger - yes and Carlson - yes. <br />Show cause ordered. <br /> <br />Authority Attorney's Report <br /> <br />Attorney Light updated the Authority on the complaint filed by The Back Room <br />and the motion to dismiss filed with the Court by the Authority Attorney per <br />instructions from the Authority. The motion to dismiss was granted by the Court <br />and the licensee has been in touch with the Authority Secretary concerning the <br />serving of the one day suspension. <br /> <br />Authority Comments <br /> <br />Authority member Carlson asked some procedural questions concerning the <br />show cause hearing ordered tonight. Attorney Light reviewed the procedural <br />issues in the show cause hearing. <br /> <br />Secretary Hanson mentioned Wahoo's has moved their restaurant out of <br />Louisville. Questions were asked concerning the withdrawal of the application for <br />a new license at 809 Main Street. Secretary Hanson reported the applicant <br />indicated to her he was having trouble justifying the expense it would take to <br />remodel the premises to his satisfaction. <br /> <br />Adjournment - Mulvahill moved to adjourn at 7:31 p.m. Rommelfanger <br />seconded.
