City Council <br /> Meeting Minutes <br /> January 8, 2013 <br /> Page 6 of 16 <br /> Council member Jasiak supported staffs recommendation in November, but noted there <br /> were some very strong points made for landmarking and for denying the application. <br /> She asked Planner I Robinson what he characterized as a significant remodel. Planner <br /> I Robinson stated bringing back the home to its original state would be a significant <br /> remodel. Peter Stewart was asked to respond to the same question and he concurred <br /> with Planner I Robinson. <br /> Council member Jasiak asked if the home at 613 Jefferson was also a miner's cabin <br /> with an addition. Planner I Robinson stated it could qualify for a miner's cabin. <br /> Council member Jasiak agreed it is not about a beauty contest, but felt there were <br /> better examples of a miner's cabin. <br /> Mayor Muckle agreed this process is not about a beauty contest, but about applying the <br /> landmarking criteria to the applications. He stated this home has a rich history of an <br /> Italian coal miner. He felt this home is architecturally and socially significant. <br /> Council member Loo stated the other two homes at 613 Jefferson and 817 Garfield <br /> were not eligible for landmarking and if 1036 Walnut is landmarked it would set a <br /> precedent and be potentially eligible for $22,000 in Historic Preservation Funds. <br /> Mayor Muckle asked City Attorney Light if the City Council is making decisions not <br /> based on the landmarking criteria. City Attorney Light stated the Council should make <br /> its decision on the criteria on this particular property. Each property has to be judged on <br /> its own merits. Council should base their decisions on the evidence presented and on <br /> the testimony given. <br /> Mayor Muckle stated the ballot language for Historic Preservation Funds permitted the <br /> use of the funds for preserving structures who qualify for landmarking. <br /> PUBLIC COMMENT <br /> Peter Stewart, 1132 Jefferson Avenue, Louisville, CO stated the significance of the <br /> home is from 1908 to 1949. He explained the applications for the two homes at 613 <br /> Jefferson and 817 Garfield were for demolition permits. He stated the code stipulates <br /> only one criteria has to be met and noted the historic preservation funds are not a part <br /> of the code. He stated it is a landmark application and not a grant application. <br /> Mayor Pro Tem Dalton felt the home should be landmarked for one period or the other. <br /> He was concerned over the Historic Preservation Commission's criteria relative to <br /> landmarking and demolition. <br /> Council member Sackett supported staff, but felt the Council had a different <br /> responsibility. He supported landmarking the property. <br />
