4. S .p lies and x, proyemeita. All City supplies, materials <br />and improvements in the Community Building shall remain the <br />property of the City and shall not be used by the Arts Council/ <br />Association unless approved by the City Council's designee. The <br />Arts Council /Association may install or make improvements to the <br />Community Building only upon approval by the City Council's <br />designee, and any such permanent improvements shall become the sole <br />property of the City. <br />5. Maintenance ana repair. The City shall continue to <br />maintain and repair the Community Building, including the provision <br />of custodial services, in the manner and at such times as the City <br />deems appropriate. <br />6. Right of entry. The City, its officers, agents, and <br />employees, shall have the right to enter the Community Building at <br />any time for any purpose. <br />7. No assignment. The Arts Council /Association may not <br />assign this agreement nor permit the use of the Community Building <br />or any portion thereof by anyone other than the Arts Council/ <br />Association and for its purposes, except as expressly approved by <br />the City Council or its designee. <br />8., Default. If the Arts Council/Association violates any <br />provision of this agreement, the City may immediately declare the <br />agreement terminated, reenter the Community Building and remove all <br />persons and all hazardous property or property which constitutes <br />a nuisance or is unlawful from the Community Building, without <br />liability to any person for damages sustained by reason of such <br />removal. Storage of any such property shall be at the cost of the <br />Arts Council /Association. Notice of such termination, reentry and <br />removal shall be promptly provided to the Arts Council /Association <br />and they shall have at least three business days following such <br />notice to remove their remaining property from the Community <br />Building. <br />9. Renewa /ter�iination This agreement shall be <br />automatically renewed for additional twelve (12) month terms by the <br />parties unless one party gives notice of non - renewal to the others <br />on or before the thirtieth day prior to the renewal date. This <br />agreement may be terminated by any party at any time upon thirty <br />days prior written notice to the other parties. <br />10. Notices.. All notices under this agreement shall be made <br />in writing, shall be deemed effective upon receipt, and may be <br />personally delivered or mailed certified or registered mail, return <br />receipt requested, as follows: <br />2 <br />
