<br />ORDINANCE NO. 1141 <br />SERIES 1994 <br /> <br />AN ORDINANCE REGULATING mE HOURS OF OPERATION <br />OF CONSTRUCTION EQUIPMENT. <br /> <br />WHEREAS, the City Council believes it is in the best interest of the City and citizens to <br />restrict the hours of operation of construction equipment, and the noise related thereto, in order <br />to protect the public health and welfare. <br /> <br />NOW, mEREFORE, BE IT ORDAINED BY mE CITY COUNCIL OF mE CITY OF <br />LOUISVILLE, COLORADO: <br /> <br />Section 1. Chapter 9.34 of the Louisville Municipal Code is hereby amended by the <br />addition of a new Section to read as follows: <br /> <br />9.34.040 <br /> <br />Opemtion of Construction Equipment <br /> <br />A. Each building permit issued on or after March 21, 1994, shall contain a <br />provision prohibiting the permittee from operating or allowing the <br />operation, outside of an enclosed structure, of any construction equipment <br />for the permitted work between the hour of 8:00 p.m. and, on weekdays, <br />the hour of 7:00 a.m. or, on legal holidays and weekends, the hour of 8:00 <br />a.m., except as provided in subsection B. <br /> <br />B. The Planning Director may, upon written application, alter the hours of <br />operation as described in subsection A or eliminate the prohibition for <br />good cause shown which may include, but shall not be limited to: <br /> <br />1. Seasonal considerations; <br /> <br />2. Mitigation of other problems to the surrounding property or <br />occupants thereof; <br /> <br />3. Written consent of occupants of surrounding property; <br /> <br />4. Lack of occupants of surrounding property; <br /> <br />5. Timing considerations based on the nature of the work being <br />performed; or <br /> <br />1 <br />
