Health or safety considerations. <br /> <br />Upon receipt of a written complaint from any person, the Planning Director <br />shall promptly revoke the alteration of hours or exemption previously <br />granted and shall promptly schedule a hearing thereon if requested by the <br />permittee with prior notice to the permittee and complainant, and shall <br />grant or deny the application based on the evidence presented at the <br />hearing. <br /> <br />C. As used in this section, "construction equipment" means any equipment or <br />devices, such as but not limited to, pile drivers, power shovels, derricks, <br />hoist tractors, loaders, rollers, concrete hauling motor vehicles, pavement <br />breakers, bulldozers, crawler-tractors, rotary drills and augers, cranes, <br />ditchers, trenchers, scrapers, wagons, pumps, compressors and pneumatic <br />power equipment, or other mechanical apparatus operated by fuel or <br />electric power in the construction, repair or demolition of any structure. <br /> <br />D. Any violation of the time limitation set out in a building permit shall be <br />subject to stop orders and other remedies provided in the City building <br />code in effect at the time. In addition, any person who violates any such <br />time limitation may be punished by a fine of not more than $1,000 or by <br />imprisonment not to exceed 1 year or by both such fine and imprisonment. <br />Each day during any portion of which any violation of any provision of <br />this ordinance is committed, continued, or permitted by any such person <br />shall be a separate offense. <br /> <br />Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City <br />Council hereby declares that it would have passed this ordinance and each part hereof irrespective <br />of the fact that anyone part be declared invalid. <br /> <br />Section 3.
