City Council <br />Meeting Minutes <br />September 18, 2007 <br />Page 4 of 7 <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br />Planning Director Wood reviewed the revisions to the Highway 42 Project Area <br />Mixed-Use Design Standards and Guidelines Mixed-Use Zoning Code: <br />• Section 17.14.050 Permitted Uses -Table 1 (3) includes the processing <br />and or wholesaling of retail food products as an accessory use. <br />• Section D (a.) Residential uses shall be allowed on the ground floor of any <br />building within the MU-R Zone District if authorized through the PUD <br />process. Ground floor three-story, residential uses are required to <br />demonstrate a compelling benefit to the City through the PUD process, <br />such as the provision of underground parking, the incorporation of green <br />and sustainable building practices, and or affordable housing. <br />PUBLIC COMMENT <br />Terry Gilkison, 798 Victoria Court, Lafayette, CO voiced his concern over the 27' <br />height limitation on residential properties. Planning Director Wood reviewed <br />Section 8 (Residential Protection and Transitional Standards) which limits <br />building heights where adjacent to residential properties zoned R-L or R-M: <br />1. Within fifty (50) feet from the edge of the street right-of-way, the average <br />height of a building shall not exceed thirty-five (35) feet. <br />2. Within fifty (50) feet from the alley centerline, or from the rear or side <br />property line of the protected residential use, the maximum height of a <br />building shall not exceed twenty-seven (27) feet. <br />Mr. Gilkison also voiced his concern over the properties located within the flood <br />plain area. He suggested rather than working within the flood plain, the City <br />remove the flood plain from the redevelopment area. He stated underground <br />parking would not be allowed in the flood plain area. <br />Michael Deborski, 600 Pine Street, Louisville, CO voiced his concern over the <br />following language in Section 17.14.050, "Includes the processing and or <br />wholesaling of retail food products as an accessory use." He suggested striking <br />the word "retail." <br />Patricia Irwin, Trustee for PI Trust, 1313 Cannon Street, Louisville, CO asked for <br />clarification on Section 17, Limitation on Existing Industrial Uses. She asked If <br />there is no existing business on an industrial property, is that property prohibited <br />from leasing to a temporary business. Planning Director Wood explained new <br />uses would require rezoning. City Attorney Light confirmed once the ordinance is <br />in effect, a temporary use would be subject to rezoning. <br />
