City Council <br />Meeting Minutes <br />September 18, 2007 <br />Page 5 of 7 <br />COUNCIL COMMENT <br />Mayor Pro Tem Brown noted the Public Works Department and the property <br />owners have discussed flood plain issues. He suggested the language in <br />Section 17.14.050 include "processing, wholesaling and retailing of products." <br />He commended the Staff for their work on the ordinance. He asked for <br />clarification on the building height issue. Wood reviewed the residential <br />protection standards, which are consistent with the Downtown standards. <br />Council member Marsella also commended Staff for their work on the revisions <br />to the ordinance. <br />Mayor Sisk addressed Mr. Deborski's concern and suggested the language <br />contain "processing, wholesale and retail food products as an accessory use." <br />There was considerable discussion relative to the appropriate language to <br />address retail as an accessory use. City Attorney Light suggested the following <br />language: "includes processing and wholesaling to retailers of food products as <br />an accessory use". He also noted on page three of the ordinance, the blank date <br />line will be filled in when the ordinance goes into effect, 30 days after adoption. <br />MOTION: Mayor Pro Tem Brown moved to approve Ordinance No. 1524, Series <br />2007, as revised, with the added language to 7.14.050 "includes processing and <br />wholesaling to retailers of food products as an accessory use." Council member <br />Marsella seconded the motion. Roll call vote was taken. The motion carried by a <br />vote of 6-0. Absent: Council member Muckle. <br />RESOLUTION No. 52, SERIES 2007 - A RESOLUTION EXPRESSING THE <br />FISCAL AND PLANNING CONTROL THAT CITY COUNCIL RETAINS OVER <br />THE LOUISVILLE REVITALIZATION PROCESS AS ESTABLISHED BY <br />COUNCIL AND URGING A NO VOTE ON INITIATIVE 2A BALLOT ISSUE <br />Mayor Pro Tem Brown spoke in support of the resolution and explained Ballot <br />Issue 2A raises issues regarding the Louisville Revitalization Commission (LRC), <br />the Cooperation Agreement between Council and the LRC, the Council's role in <br />the urban renewal efforts and the urban renewal plan. He stated if Ballot Issue <br />2A passes, it will have significant impacts on the development environment in the <br />City of Louisville. Resolution No. 52 affirmatively makes statements derived from <br />the urban renewal plan docurrientation and recounts the City Attorney's advice. <br />• The LRC cannot make any expenditure that has not been previously <br />approved by the Louisville City Council. <br />• The LRC cannot independently establish any tax increment financing plan, <br />whether through property or sales tax, or any other form of tax <br />• The LRC has no land use approval authority for the urban renewal area. <br />
