<br />ORDINANCE NO. 1473 <br />SERIES 2005 <br /> <br />AN EMERGENCY ORDINANCE OF THE CITY OF LOUISVILLE <br />ESTABLISHING A TEMPORARY MORATORIUM ON THE <br />PROCESSING OF APPLICATIONS FOR APPROVAL OF REZONINGS, <br />SPECIAL REVIEW USES, AND PCZD GENERAL DEVELOPMENT PLAN <br />AMENDMENTS FOR NEW RESIDENTIAL DEVELOPMENT LOCATED <br />WITHIN THE CITY, AND CREATING CERTAIN EXEMPTIONS FROM <br />THE MORATORIUM. <br /> <br />WHEREAS, the City of Louisville is a home rule municipal corporation organized under <br />and pursuant to Article XX of the Colorado Constitution and the Louisville Home Rule Charter; <br />and <br /> <br />WHEREAS, by virtue of such authority, and as further authorized by state statutes, <br />including but not limited to c.R.S, ~~ 29-20-101 et seq, and 31-23-301 et seq" the City has broad <br />authority to plan for and regulate the use and development of land on the basis of impact thereof on <br />the community and surrounding areas; and <br /> <br />WHEREAS, pursuant to such authorities, the City has established zoning districts and zone <br />district ordinances and regulations for land within the City to, among other things, promote the <br />general welfare of the inhabitants of the City; and <br /> <br />WHEREAS, pursuant to such authorities, the City has also adopted a Citywide <br />Comprehensive Plan, which Plan was last updated on a Citywide basis in 1989 and which Plan <br />serves as a guiding document containing the policy framework under which new development <br />and redevelopment within the City will be evaluated; and <br /> <br />WHEREAS, the City Council on April 20, 2004 formally initiated a process to review <br />and update the City's Comprehensive Plan, which process consists of several phases and includes <br />various workshops, meetings and hearings regarding the drafting and potential adoption of an <br />updated Citywide Comprehensive Plan; and <br /> <br />WHEREAS, a draft updated Citywide Comprehensive Plan was presented to a joint <br />meeting of City Council and the Planning Commission on January 25,2005; and <br /> <br />WHEREAS, the Planning Commission held public hearing sessions regarding the <br />Citywide Comprehensive Plan on February 24, March 15, April 21, April 28, May 19, May 26, <br />June 6, and June 9, 2005; and <br /> <br />WHEREAS, the Planning Commission on June 9, 2005 adopted its Resolution No. 15, <br />Series 2005, forwarding its recommendation on the Citywide Comprehensive Plan, and <br />transmitted such Resolution and recommended Citywide Comprehensive Plan to the City <br />Council at ajoint meeting of the City Council and Planning Commission on June 20,2005; and <br /> <br />1 <br />
