WHEREAS, the City Council has held public hearing sessions regarding the Citywide
Comprehensive Plan on June 20, June 21, July 5, and July 12, 2005; and

WHEREAS, City Council review of the Citywide Comprehensive Plan is ongoing, and
City Council anticipates taking final action on a Citywide Comprehensive Plan on August 16,
2005; and

WHEREAS, one of the critical issues under evaluation as part of the Comprehensive
Plan review is the question of additional residential development within the City, including
analysis of appropriate locations for additional residential development, the impacts of residential
development, and the policies under which such development might occur; and

WHEREAS, in light of the review of the Citywide Comprehensive Plan, the City
Council previously imposed temporary moratoria on the processing of applications for rezonings,
special review uses and Planned Community Zone District (PCZD) general development plan
amendments for new residential development, by Ordinance No. 1450, Series 2004, which
expired on March 31, 2005, and Ordinance No, 1469, Series 2005, which expires August 2,
2005; and

WHEREAS, in light of the continued review of the Citywide Comprehensive Plan, City
Council finds it appropriate to extend the temporary moratorium on the processing of
applications for rezonings, special review uses, and PCZD general development plan
amendments for new residential development; and

WHEREAS, the City Council finds that such a moratorium will permit the City an
appropriate amount of time to continue and complete its Citywide Comprehensive Plan review;
will foster sound land use planning and governmental decision making; and will not affect the
development of properties which are currently permitted by right to pursue residential
development upon compliance with all other City ordinances, rules, regulations, policies and
design guidelines; and

WHEREAS, the City Council has held a public hearing on the temporary moratorium,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LOmSVILLE, COLORADO:

Section 1. The foregoing recitals are hereby affirmed and incorporated herein by this
reference as findings of the City Council.

Section 2. Upon the effective date of this ordinance, and until September 7, 2005, no
application for approval of a rezoning, a special review use, or a Planned Community Zone District
