All were in favor. <br /> MOTION: Mayor Muckle moved the City Council convene an executive session for the <br /> purpose of consideration of potential real property acquisition — parcels of real property <br /> in Louisville. but only as to appraisals, value estimates and strategy for such property <br /> acquisition and the executive session include the City Council, City Manager, City <br /> Attorney, Economic Development Director and Deputy City Manager. Mayor Pro Tern <br /> Dalton seconded the motion. All were in favor. The City Council went into executive <br /> session at 8:02 p.m. The City Council reconvened the regular meeting at 8:59 p.m. <br /> REGULAR BUSINESS ITEMS CONTINUED <br /> REPORT— DISCUSSION/DIRECTION/ACTION — REAL PROPERTY ACQUISITION <br /> AND DISPOSITION <br /> City Attorney Light reported in executive session the City Council discussed real <br /> property acquisitions and dispositions. The City Council provided direction to the staff <br /> on possible strategies on potential disposition of property owned by the City and the <br /> potential acquisition of real property. He noted if negotiations result in a proposal or <br /> contract, the matter would come back for City Council review at a future meeting. <br /> CITY ATTORNEY'S REPORT <br /> City Attorney Light reported the Colorado Legislators are considering a bill, which <br /> pertains to raising the Tort limits in Colorado, for the amount claimants can recover from <br /> local government entities. Currently if someone is injured on public property and is able <br /> to prove negligence, the current maximum recovery is $150,000 per person and the <br /> multiple person level is capped at$600,000. Under the proposed bill the maximum an <br /> individual could recover is raised to $460,000, and the multiple person level is capped at <br /> $ 1 Million. The amounts were calculated by an assumed rate of inflation. He noted the <br /> $150,000 level was adopted in 1972. CML is currently working on potential <br /> amendments and one change would take interest outside of the caps. This bill would <br /> require the Attorney General to change the cap. City Attorney Light would send a copy <br /> of the bill to City Manager Fleming for distribution to City Council. <br /> Council member Loo suggested the Council direct the City Manager to send a letter to <br /> the City's representatives letting them know the Council does not believe this is a wise <br /> idea. Mayor Muckle stated CML has taken a middle-ground position. City Manager <br /> Fleming stated it would be a significant impact on cities if the cap was increased. <br /> Council supported expressing their concern on the subject. <br />
