City Council <br />Meeting Minutes <br />April 2, 2013 <br />Page 19 of 23 <br />City Attorney Light read Ordinance No. 1629, Series 2013 and noted there are second <br />reading amendments. <br />Mayor Muckle requested a five - minute recess at 10:30 p.m. The meeting reconvened <br />at 10:35 p.m. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />Principal Planner McCartney explained this is a request to amend the Louisville <br />Municipal Code (LMC), which currently permits kennels as a special review use in the <br />Industrial Zone District. Staff requested the LMC be amended to allow kennels in the <br />CC Zone District. <br />COUNCIL COMMENTS <br />Mayor Muckle asked if this was a specific request from a member of the public. <br />Principal Planner McCartney stated it was a specific request from an individual, who has <br />since withdrawn their application. Staff believes the LMC should be updated to allow for <br />modern pet care business plans to include daycare or overnight care and pet grooming. <br />The term "Kennel" is antiquated and after reviewing other communities definitions and <br />codes staff supports kennels in a CC Zone District by Special Review. <br />SRU applications require a site plan, where Performance Standards regulate how <br />proposed businesses may operate. Performance Standards may include: hours of <br />operation; occupancy numbers; noise and waste /smell odor. Performance standards <br />are all the criteria for which an SRU is reviewed should there become a nuisance on the <br />property. If the business does not continue to comply with the performance standards <br />then the use may be recalled to Planning Commission and City Council for re- <br />evaluation. <br />City Attorney Light reviewed the second reading amendments as follows: <br />• Sec. 17.08.255. Pet Care Businesses: Last sentence added: "This term <br />includes without limitation kennels ". <br />• Section 3 — delete the word "Kennels" from the chart <br />• Add Section 4 — Subsection A of 17.16.220 was amended to read: <br />• Sec. 17.16.220 — Salvage yards, kennels and feedlots. Salvage junkyards and <br />kennels shall be subject to minimum separation requirements from any <br />residential uses, as established at the time of special review use approval, <br />including any amendment thereto. <br />Staff recommended the City Council approve Ordinance No. 1629, Series 2013, as <br />amended, on second and final reading. <br />Mayor Muckle requested public comment and hearing none, closed the public hearing. <br />
