1111 <br />IIIV <br />II <br />11 <br />IIHH <br />06121 2013 03 50 PM <br />Boulder County Clerk, CO <br />INTERGOVERNMENTAL AGREEMENT <br />11 <br />11 <br />in <br />RF: $56 00 <br />11 <br />This intergovernmental Agreement ( "Agreement ") is between the City of Lafayette, a Colorado <br />home rule municipality ( "Lafayette "), and the City of Louisville, a Colorado home rule <br />municipality ( "Louisville "), collectively the "Parties ", and is made to be effective as of the <br />7 day of gune_ , 2013. <br />RECITALS <br />1. The North End Phase II Subdivision, a project entirely within the City of <br />Louisville is generally located in the east half of the SW1/4, Sec 4, TIS R69W, 6th P.M. is <br />proposed to be constructed by a Louisville developer. <br />2. The North End Phase II Subdivision includes a sanitary sewer lift station. The <br />sanitary sewer lift station is proposed within Outlot 12, North End Parcel 1, Outlot H and Outlot <br />K Replat. <br />3. The proposed sanitary sewer lift station includes an emergency overflow <br />connection to the City of Lafayette sanitary sewer collection system. <br />4. The City of Lafayette has existing waste water facilities which have the capacity <br />to convey and treat sanitary sewer overflow discharges from Louisville's North End Phase 1I <br />sanitary sewer lift station. <br />5. The Parties desire to enter into an IGA to establish responsibilities for the sanitary <br />sewer lift station emergency overflow connection to the City of Lafayette sanitary sewer <br />collection system, and related matters. <br />6. The Parties are authorized to enter into this Agreement pursuant to their <br />respective charters and state law, including but not limited to C.R.S. § 29 -1 -203. <br />AGREEMENT <br />In consideration of the terms and provisions herein, the Parties agree as follows: <br />1. Sanitary Sewer Emergency Overflow Connection. <br />a. The Parties agree that the developer of the North End Phase II Subdivision <br />shall construct a sanitary sewer lift station. The sanitary sewer lift station shall include an <br />emergency overflow connection to the City of Lafayette sanitary sewer collection system. <br />The emergency overflow connection shall be constructed in accordance Exhibit A <br />attached hereto and incorporated herein by reference. <br />b. The sanitary sewer lift station and emergency overflow connection shall <br />be owned and maintained by the City of Louisville.
