permits, and other procedural or substantive permits and approvals that are necessary for <br />construction, operation and maintenance of the emergency overflow connection. <br />c. Louisville shall be required to obtain site application approval from the <br />Colorado Department of Public Health and Environment for the sanitary sewer lift station <br />as soon as reasonably practicable and provide proof of such to Lafayette. <br />d. Louisville shall for any day or part thereof during which Louisville <br />domestic sewage flows are routed through the emergency overflow connection to <br />Lafayette's sanitary sewer collection system pay Lafayette $100 per day plus any direct <br />labor expenses associated with an event. <br />e. An extra charge of $25 per day per tap shall be incurred for each <br />Louisville tap directly contributing non - domestic sewage flow to the flows routed <br />through the emergency overflow connection to Lafayette's sanitary sewer collection <br />system. Louisville shall on an annual basis submit a written report to Lafayette <br />identifying all potential toxic pollutants and or hazardous waste and the sources thereof <br />located within the area to be served by the emergency overflow connection. <br />f. Lafayette will review and subject to its standards and specifications <br />approve the civil engineering plans and construction drawings for the lift station and the <br />emergency overflow connection. <br />g. Louisville will provide Lafayette annual maintenance records of <br />commercial grease traps installed within North End Phase II Subdivision. Such records <br />will be maintained consistent with the requirements of C.R.S. § 24 -72 -201 et se q. <br />h. The sanitary sewer lift station shall be operated and maintained to <br />applicable Colorado Department of Public Health & Environment (CDPHE) regulations. <br />The emergency operation plan required by CDPHE shall be submitted to Lafayette for <br />review and approval no later than three months from the date of the Parties execution of <br />this Agreement. Louisville will perform regular maintenance inspections of the sanitary <br />sewer lift station, keep and maintain required documentation, and submit facility reports <br />to the State as required. At Lafayette's request, Louisville shall provide copies of all <br />reports, inspections and maintenance records for the preceding twelve (12) months. The <br />sanitary sewer lift station design shall include an external warning light to show when <br />flows are being sent through the emergency overflow connection to Lafayette. <br />i. Lafayette Water Reclamation Facility operators shall be notified <br />immediately when the emergency overflow connection is being used. <br />j. Louisville shall promptly correct any malfunctions in operation of the <br />sanitary sewer lift station causing emergency overflow, and shall promptly provide <br />Lafayette notice of same. Non - emergency corrections or repairs shall be completed <br />within a reasonable time not to exceed 30 days (unless, after promptly commencing the <br />2 <br />
