City Council <br />Meeting Minutes <br />July 2, 2013 <br />Page 8 of 22 <br />slight change to the street network to allow another access of South Boulder Road, <br />which will continue Front Street from Little Italy to South Boulder Road and moving the <br />intersection of Cannon Circle and Highway 42 further south to allow for a traffic signal. <br />The last major change request removes the park along Highway 42. The applicant <br />proposes, as an alternative, a centrally located park and linear multi -use path through <br />the development, which would be publicly accessible but privately maintained by the <br />Home Owners Association. <br />Section 16.16.060 of the Louisville Municipal Code requires a 15% public land <br />dedication for residential subdivisions and 12% of the net commercial area. The <br />requirement may be waived by City Council if previous dedications were made. It has <br />been City policy not to require public land dedication on replats. This property was <br />subdivided as Caledonia Place in 1890, but never developed therefore staff is not <br />requesting a public land dedication. <br />COUNCIL COMMENTS <br />Council member Jasiak asked for clarification on the public land dedication policy. <br />Planning Director Russ explained the City's policy on properties previously platted has <br />been to not require a land dedication. He noted there is room in the Code to interpret it <br />differently in terms of requiring a land dedication above what was dedicated in a <br />previous plat. He noted that has not been the City staff's practice. If Council direct staff <br />to change the methodology, there would be a demand analysis performed to compare <br />the previous subdivision to the current subdivision to see what demand there would be <br />on City services. Staff would have to establish the methodology, but in order to remain <br />consistent, would not recommend it in this particular case. <br />Mayor Pro Tem Dalton inquired whether there would be a public purpose served by a <br />land dedication. Planning Director Russ explained the methodology is more for a <br />Greenfield expanding City rather than a redevelopment. The logic behind the <br />methodology determines what the public needs are for a particular site. There are <br />Impact Fees, which all development must pay for regional improvements not site <br />specific. Public land dedication is site specific. He explained the proposal is Tess in <br />demand in place than what was entitled with the previous plat. <br />Planner I Robinson addressed the Preliminary Subdivision Plat and noted the proposed <br />block layout complies with the Mixed Use Development Design Standards and <br />Guidelines (MUDDSG) and matches in scale and style with the existing residential <br />neighborhood to the south. The block lengths and widths are appropriate, and alley <br />access is provided for all residential units. The commercial section follows the <br />requirements of the MUDDSG by moving the buildings to the street and providing <br />parking behind. <br />
