<br />RESOLUTION NO. 17 <br />SERIES 2005 <br /> <br />A RESOLUTION APPROVING AN AMENDMENT TO A GRANT CONTRACT <br />BETWEEN THE CITY OF LOUISVILLE AND THE COLORADO DEPARTMENT OF <br />TRANSPORTATION FOR A STUDY CONCERNING A SEGMENT OF STATE <br />HIGHWAY 42/96TH STREET <br /> <br />WHEREAS, the City has been selected to receive a grant of federal funds for partial <br />funding of a study project to consider future capacity enhancements, intersection and safety <br />improvements, and multi modal facilities, for conceptual design, for 104th Street north to Pascal <br />Drive, on State Highway 42/96th Street; and <br /> <br />WHEREAS, to implement the grant, the City previously entered into a contract with the <br />State of Colorado, for the use and benefit of the Colorado Department of Transportation, which <br />contract was approved by Resolution No. 57, Series 2004; and <br /> <br />WHEREAS, the parties have determined there is additional eligible funding for the study, <br />and desire to execute an amendment to the contract to, among other things, increase the amount of <br />funding eligible for federal participation and the amount of the City's matching funds; and <br /> <br />WHEREAS, the City is authorized by law to enter into the contract amendment, and the <br />City Council finds and determines that execution of such amendment is in the best interest of the <br />City and its citizens. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />1. The City Council hereby approves that certain Contact Amendment #1 to the <br />Contract between the City of Louisville and the State of Colorado for the use and benefit of the <br />Colorado Department of Transportation, for partial funding of a study to consider future capacity <br />enhancements, intersection and safety improvements, and multi modal facilities, for conceptual <br />design, for 104th Street north to Pascal Drive, on State Highway 42/96th Street. A true copy of the <br />Contract Amendment is attached hereto. <br /> <br />2. The Mayor is hereby authorized to execute the Contract Amendment on behalf of <br />the City Council of the City of Louisville, except that the Mayor is hereby further authorized to <br />negotiate and approve such revisions to the Contract Amendment as the Mayor determines are <br />necessary or desirable for the protection of the City, so long as the essential terms and conditions of <br />the Contract Amendment are not altered. <br /> <br />3. The Mayor, City Manager, City Clerk and City staff are hereby authorized to <br />execute all documents and do all other things necessary on behalf of the City to effectuate the grant <br />under the Contract as amended and to perform the obligations of the City under the Contract as <br />amended. <br />
