City Council <br />Meeting Minutes <br />July 16, 2013 <br />Page 18 of 25 <br />Planning Director Russ stated this would be the last time Council will be reviewing the <br />South Street Underpass Design. The final drawing if accepted by BNSF, will be built by <br />BNSF. <br />DISCUSSION /DIRECTION RECREATIONAL MARIJUANA <br />Mayor Muckle requested a staff presentation. <br />Deputy City Manager Balser explained the City Council directed staff to prepare for the <br />allowance and regulation of marijuana establishments. If the City does not prohibit retail <br />marijuana establishments, Amendment 64 authorizes local governments to enact <br />regulations governing the time, place, manner and number of marijuana establishment <br />operations. <br />At the end of the legislative session, the Colorado Legislature adopted H.B. 13 -1317, <br />H.B. 13 -1318, and S.B. 13 -283 concerning retail marijuana. On July 1, the Department <br />issued emergency rules concerning retail marijuana, which rules will expire 120 days <br />from the date of adoption. The Department has stated it intends to adopt final rules by <br />January 1, 2014. <br />In preparation for drafting ordinances for Council consideration, the City Attorney and <br />staff reviewed the emergency rules and new laws and have identified items requiring <br />specific direction from City Council. Does the City Council wish to regulate retail <br />marijuana similar to how the City regulates alcohol sales, or should additional <br />regulations be implemented? Staff requested direction on issues 1 -6: <br />1. Licensing: Does Council support the dual licensing scheme, with the Louisville <br />Licensing Authority issuing licenses for retail marijuana establishments? The City <br />Council supported local licensing <br />2. Land Use / District Regulations: <br />A. Does Council wish to place a cap on the number of retail marijuana <br />establishments? <br />B. Does Council wish to expand possible locations to zoning districts other than <br />the Commercial Business (CB) District, where medical marijuana centers are <br />located, to Commercial Community (CC) and Planned Community Zone <br />District - Commercial (P -C)? <br />COUNCI L COMMENTS <br />Council member Keany supported a distance requirement between establishments but <br />did not believe caps were necessary. <br />
