<br /> <br />10 <br /> <br />for occupancy with such furniture, fixtures, and equipment in place as are necessary to <br />comply with this chapter and any applicable provisions of this Code or state law or <br />regulation and until the Planning and Building Safety Department has performed the <br />inspection required by this chapter. <br /> <br />Sec. 5.11.080. Location Criteria. <br /> <br />A. No retail marijuana establishment shall, at the time it is established and first <br />licensed by the city, be located: <br /> <br />1. within one thousand (1,000) feet of: a public or private preschool, elementary, <br />middle, junior high, or high school; or a public playground; <br />2. upon any city property; <br />3. in a dwelling unit or any residentially zoned districts; or <br />4. within the Agricultural (A), Open Space (OS), Administrative Office Transitional <br />(AO-T), Administrative Office (A-O), Business Office (B-O), Mixed Use (MU-R), <br />or Commercial Neighborhood (CN) zone districts, or any other zoned area in <br />which the retail marijuana establishment is not a permitted use. <br /> <br />B. No licensed premises for a retail marijuana store shall, at the time it is established <br />and first licensed by the city, be located in a physical space exceeding five thousand <br />(5,000) square feet of leasable floor space, nor shall such licensed premises ever exceed <br />five thousand (5,000) square feet of leasable floor space. <br /> <br />C. No retail marijuana establishment shall operate as an outdoor or transient <br />retailer, vendor or peddler, or as any temporary or accessory use. <br /> <br />D. The distances described in subsection A above shall be computed by direct <br />measurement in a straight line from the nearest property line of the land used for the <br />purposes stated in subsection A above to the nearest portion of the building or unit in <br />which the retail marijuana establishment is located. <br /> <br />F. Medical marijuana businesses and retail marijuana establishments are subject to <br />the following shared licensed premises and operational separation requirements: <br /> <br />1. A medical marijuana-infused products manufacturing business licensee may <br />also apply to also hold a retail marijuana product manufacturing facility license <br />and operate a dual manufacturing business on the same licensed premises. <br />Persons operating medical marijuana-infused products manufacturing <br />business and retail marijuana products manufacturing facility shall maintain <br />either physical or virtual separation of the facilities, product ingredients, <br />product manufacturing, and final product inventory. Record keeping for the
