RESOLUTION NO. 42 <br />SERIES 2013 <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE (SRU), REZONING, <br />PRELIMINARY SUBDIVISION PLAT, PRELIMINARY PLANNED UNIT <br />DEVELOPMENT (PUD), AND AMENDMENTS TO CHAPTER 17.14 OF THE <br />LOUISVILLE MUNICIPAL CODE FOR AN APPROXIMATE 14.18 ACRE PARCEL OF <br />THE INDUSTRIAL AREA AND CALEDONIA PLACE SUBDIVISIONS. THE INTENT <br />OF THE REQUEST IS TO DEVELOP THE PROPERTY WITH 244 RESIDENTIAL <br />UNITS AND 12,000 SQUARE FEET OF COMMERCIAL SPACE <br />WHEREAS, there has been submitted to the. Louisville City Council an <br />application for approval of an SRU, rezoning, preliminary subdivision plat, preliminary <br />planned unit development (PUD), and amendment to Chapter 17.14 of the Louisville <br />Municipal Code (LMC) for an approximate 14.18 acre parcel of the Industrial Area and <br />Caledonia Place subdivisions. The intent of the request is to develop the property with <br />244 residential units and 12,000 square feet of commercial space; and <br />WHEREAS, the subject property is in the Highway 42 Revitalization Area; and <br />WHEREAS, Section 17.14.020 of the LMC requires any property in the Highway <br />42 Revitalization Area be rezoned in conformance with the Land Use Plan incorporated <br />as Exhibit A in LMC Chapter 17.14 before being developed or redeveloped; and <br />WHEREAS, a change to the Land Use Plan (Exhibit A) is required to allow for a <br />functional and efficient development; and <br />WHEREAS, the modified Land Use Plan (Exhibit A) requires the existing <br />Industrial (I) zoning to be rezoned to Mixed -Use Residential (MU -R); and <br />WHEREAS, the ground floor residential along Cannon Street requires a special <br />review use permit and staff has found the request with conditions meets the five criteria <br />established in Section 17.40.100 in the LMC; and <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with the LMC Sec. 16.12.030, Sec. 17.14.090, Sec. 17.28.170; and Sec. <br />17.40.100; and <br />WHEREAS, after a duly noticed public hearing on August 20, 2013 where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville City Council Staff Report dated August 20, 2013, the City Council finds the <br />DELO SRU, Rezoning, Preliminary Subdivision Plat, Preliminary PUD Plan, and LMC <br />amendments should be approved with specific conditions. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br />Colorado does hereby approves an SRU, Rezoning, Preliminary Subdivision Plat, <br />Resolution No. 42, Series 2013 <br />Page iof4 <br />
