City Council <br />Meeting Minutes <br />August 20, 2013 <br />Page 12 of 23 <br />Mayor Pro Tem Dalton felt the City is getting public land dedication through the <br />easements. He encouraged staff to work on code revisions to address public land <br />dedication for greenfield developments. <br />Mayor Muckle addressed the issue of long -term maintenance of the property. <br />Council member Jasiak emphasized the importance of safety of the streets around <br />Miners Field where children are present. She supported a code revision to provide <br />clear direction for public land use dedication for greenfield areas. She voiced her <br />concern over the DELO development transition into the existing neighborhoods of <br />Miners Field and Little Italy and hoped it would be resolved at the Final PUD process. <br />She thanked the developers. <br />Council member Keany asked how the public green spaces would affect the TIF. City <br />Attorney Light explained the TIF dollars are from assessed valuation from new taxable <br />construction. He stated the land in question is not intended for new construction. He <br />explained there would be property value assessed when the building permit is issued <br />and forwarded to the County Assessor. The County Assessor will assess the actual <br />valuation for new taxable construction. The TIF is assessed on all vertical construction. <br />Council member Keany voiced his belief the property would be improved and be more <br />valuable and if privately owned would generate property taxes. <br />Mayor Muckle agreed with Ms. Morgan and Council member Jasiak relative to the <br />safety of the streets around the Miners Field neighborhood. He felt the parking for RTD <br />is problematic, but noted there are areas within 500 feet of the railroad platform. <br />Mayor Muckle requested public comment and hearing none, closed the public hearing. <br />RESOLUTION No. 42, SERIES 2013 — A RESOLUTION APPROVING A SPECIAL <br />REVIEW USE (SRU), REZONING, PRELIMINARY SUBDIVISION PLAT, <br />PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD), AND AMENDMENTS TO <br />CHAPTER 17.14 OF THE LOUISVILLE MUNICIPAL CODE FOR AN APPROXIMATE <br />14.13 ACRE PARCEL OF THE INDUSTRIAL AREA AND CALEDONIA PLACE <br />SUBDIVISIONS. THE INTENT OF THE REQUEST IS TO DEVELOP THE PROPERTY <br />WITH 244 RESIDENTIAL UNITS AND 12,000 SQUARE FEET OF COMMERCIAL <br />SPACE <br />City Attorney reviewed the City Council's two new conditions to Resolution No. 42 as <br />follows: <br />#5 The project shall include fire sprinklers throughout all buildings, in accordance <br />with a City and Fire District approved plan. <br />#6) The privately owned and maintained streets shall be subject to perpetual <br />easements for public parking and public access at all times. <br />
