City Council <br />Meeting Minutes <br />August 20, 2013 <br />Page 17 of 23 <br />NAPA building is held back until the stabilization is complete. The property cannot be <br />conveyed until it is Iandmarked, which is consistent with the Ballot Issue. <br />Council member Jasiak thanked Mr. Caranci and Mr. Hartronft for their work. She <br />explained she was one of the first girls to graduate from J.K. Mullin High School and it <br />was J.K. Mullin who built the grain elevator. <br />Mayor Muckle requested public comment and hearing none, closed the public hearing. <br />Council member Sackett expressed his pleasure that so much progress has been <br />made. He requested the term inhabitable be struck. Mr. Hartronft explained the reason <br />it cannot be made habitable is the difference between their proposal and the Old Town <br />Group proposal, approximately one million dollars of public funding. Their goal is to get <br />it as close as possible. <br />Mayor Muckle explained the grain elevator will be habitable in terms of being clean, safe <br />and weather tight. <br />City Attorney Light reviewed the revisions to Resolution No. 44, Series 2013 which <br />include a new section five, and the authority for the Mayor and City Manager to execute <br />the agreement and to negotiate and approve revisions as they determine to be <br />necessary for the protection of the City, so long as the essential terms and conditions <br />are not altered. <br />Revisions to the Agreement include adding to the end of Section 9.20.2.2: "only for <br />grading and turf, gravel or other ground surface treatments needed to provide property <br />drainage of the site." Added to the end of Section 9.20.2.3: "if permitted under Ballot <br />Issue 2A approving the Historic Preservation Tax." <br />MOTION: Council member Loo moved to approve Resolution No. 42, Series 2013, as <br />amended, seconded by Council member Jasiak. Roll call vote was taken. The motion <br />carried by a vote of 6 -0. Absent: Council member Yarnell. <br />RESOLUTION No. 3, SERIES 2013 — A RESOLUTION DESIGNATING THE <br />LOUISVILLE GRAIN ELEVATOR LOCATED AT 540 COUNTY ROAD A HISTORIC <br />LANDMARK - PUBLIC HEARING <br />Mayor Muckle requested a staff presentation. <br />Planner I Robinson explained the application to landmark the Louisville Grain Elevator <br />is back before the City Council for the fifth time. If Council approves the agreement with <br />Louisville Mill Site LLC, staff recommended landmarking the grain elevator structure <br />now. Landmarking is a precondition to any transfer of the property and the proposal with <br />Louisville Mill Site LLC calls for a conservation easement on the proposed Lot 2 of the <br />property to protect views of the grain elevator.
