Roll call vote was taken. The motion carried by a vote of 6 -0. <br />Absent: Council member Yarnell. <br />ORDINANCE No.1640, SERIES 2013 — AN ORDINANCE AUTHORIZING THE <br />PAYMENT OF CITY MONEYS FOR THE ACQUISITION OF PROPERTY <br />LEGALLY DESCRIBED AS LOTS 6, 7 AND 12, COLORADO <br />TECHNOLOGICAL CENTER FILING NO. 2, CITY OF LOUISVILLE, BOULDER <br />COUNTY, COLORADO — 1sT READING — SET PUBLIC HEARING 9/3/13 <br />MOTION: Mayor Muckle moved to approve Ordinance No. 1640, Series 2013, <br />seconded by Mayor Pro Tem Dalton. Roll call vote was taken. The motion carried by a <br />vote of 6 -0. Absent: Council member Yarnell <br />Council member Keany left the meeting at 11:00 p.m. <br />DISCUSSION /DIRECTION /ACTION — SIXTH AMENDED EMPLOYMENT <br />AGREEMENT (CITY MANAGER MALCOLM FLEMING) <br />Mayor Muckle explained the City Council met in executive session on August 6, 2013 to <br />discuss the City Manager evaluations for the period of August 15, 2012 through August <br />14, 2013 and the Sixth Amended Employment Agreement for City Manager Malcolm <br />Fleming. The City Council discussed and made suggestions for improvements. <br />City Attorney Light reviewed the Sixth Amended Employment Agreement for City <br />Manager Malcolm Fleming as follows: The Agreement reflects a base salary increase <br />of $3,286.40 or 2.0% over 2012 -13 base salary. Other compensation and benefits <br />remain same as current. In Section 9, the City's 401 -A retirement plan contribution rate <br />has been revised to reflect the Citywide contribution rate increase that took effect in <br />January 2013. The base salary increase is recommended to the Council in order to <br />reward performance, maintain the City's pay philosophy to pay market wages based on <br />the City's defined labor market, and adjust pay via incremental adjustments. <br />MOTION: Mayor Muckle moved to approve the evaluation and Sixth Amended <br />Employment Agreement for City Manager Fleming, seconded by Mayor Pro Tem <br />Dalton. Roll call vote was taken. The motion carried by a vote of 5 -0. Absent: Council <br />members Yarnell and Keany. <br />
