City Council <br />Meeting Minutes <br />August 7, 2007 <br />Page 10 of 14 <br />as presented. The proposed improvements do not create additional building <br />area and therefore do not generate an additional parking requirement. <br />The applicant is requesting to install a 6 foot high privacy fence along the north <br />and west perimeter of the outside patio, a run of about 55 feet. The placement of <br />this fence will require approval of a building permit by the City of Louisville. No <br />additional landscape improvements are being proposed for the outdoor patio. <br />The applicant proposes to place lighting along the fence to provide low wattage <br />illumination to the back patio area. Staff requires such lights be turned off when <br />the patio is closed and located below the top of the fence and shielded and <br />downcast so no light spills outside of the outdoor patio area. <br />The Planning Commission held a public hearing on July 12, 2007 and forwarded <br />a resolution of support with thie following conditions to the City Council: <br />1. Hours of operation for the outdoor patio shall be limited to 9 p.m. Sunday <br />through Thursday, and 1 CI p.m. Friday and Saturday. <br />2. There shall not be any live or taped music played on the patio at anytime. <br />3. Lighting should be limited to low wattage down-cast lighting placed no <br />higher than the top of irhe fence. This will alleviate any refuge light from <br />spilling out of the patio area onto adjacent areas. <br />4. Employees shall park in existing long term parking areas, and not on the <br />street or in 2-hour lots, <br />5. Fencing on site shall not exceed a height of 6 feet and shall be solid <br />fencing to screen the outdoor use from adjacent uses. <br />Mayor Sisk requested an Applicant presentation. <br />Louis Karp explained he and his son Joshua are the owners of the Waterloo Ice <br />House. They have agreed toy the conditions of the Special Review Use in the <br />spirit of being good neighbors. He noted it would create overcrowding in his <br />establishment but they will ak~ide by the conditions. <br />PUBLIC COMMENT <br />Sonja Sobels, 808 LaFarge Avenue, Louisville, CO addressed a petition signed <br />by 25 neighbors. The petition expressed concern for potential noise issues. She <br />supported the conditions set forth in the Special Review Use. <br />Andrew Muller, 3808 S. Vincent Place, Boulder, CO voiced his support for the <br />Waterloo Ice House Special (Review Use. <br />Janice Kelly, representing TE:BO Development, voiced their support of the <br />outdoor patio for the Waterloo Ice House. <br />
