City Council <br />Meeting Minutes <br />August 7, 2007 <br />Page 11 of 14 <br />Mark Zaremba, representing 'the Downtown Business Association, voiced their <br />support for the Waterloo Ice Fiouse requested patio. <br />Sarah Flynn, 1433 Wilson Placeā€ž Louisville, CO expressed her concern over <br />smoking and noise issues associated with the outdoor patio request. <br />Marianne Gibbs, 822 LaFargE: Avenue, Louisville, CO voiced her support of the <br />outdoor patio and the Special Review Use conditions. She expressed her <br />concern over loitering and smokiing in the alley. <br />COUNCIL COMMENT <br />Council member Muckle supported the Waterloo Ice House, but suggested the <br />smoking and loitering issues be addressed. He requested the patio area not be <br />a primary point of entrance. I-le supported revisiting this Special Review Use in <br />six months to review the patio use. <br />Council member Yarnell supported a six-month view of the Special Review Use. <br />Council member Clabots asked lif a Special Review Use can be called up at any <br />time by City Council. Planninig Director Wood explained a Special Review Use <br />can be called up at any time upon a complaint. <br />Council member Clabots favored a review within atwelve-month period and <br />suggested shorter patio hours. <br />Council member Marsella voiced her concern over a review of the Special <br />Review Use in light of the property's owners' investment in the property. <br />Council member Yarnell statE;d a review would not be in response to a complaint, <br />but to determine whether the conditions are effective or should be modified. <br />Mayor Sisk did not want people exiting from the patio area, but felt the liquor <br />license would restrict such activities. He also shared Council member Marsella's <br />concern over the review of the SRU. He noted the City has a noise ordinance, <br />but stressed the importance of controlling the decibel levels. <br />Mr. Karp explained they havE; already received complaints regarding construction <br />noise. He asked at what point the Special Review Use would be called up, and <br />whether he should have the decibel levels tested. <br />Mayor Sisk suggested the neighbors would probably appreciate the applicant <br />taking some pro-active measures on having decibel levels measured. <br />
