City Council Meeting Minutes September 18, 2007 Page 6 of 7 City Attorney Light explained the Colorado Fair Campaign Act prohibits a municipality from spending money to sway the electors from voting for or against any measure other than passing a resolution in support or opposition to the measure. He reviewed the to-rms of the Cooperation Agreement between the City of Louisville and the Louisville Revitalization Commission and noted there is no expressed provision for either party to unilaterally terminate. Mayor Sisk explained no action will be taken on Resolution No. 52, Series 2007 until the October 2, 2007 City Cc-uncil meeting. PUBLIC COMMENT Rob Lathrop, 601 Johnson Avenue, Louisville, CO stated his advocacy is for the business community. He reported on conversations with local businesses who want to know the City Councill's position on the issue. John Leary, 1016 LaFarge Avenue, Louisville, CO stated the resolution should not be considered and noted 'the Council's position is already on record. He stated taxpayer's money cannot be used for promoting candidates or issues. He declared the citizens reserve the right of initiated legislation. David Waldman, 1871 Continental View Drive, Louisville, CO reported on his discussions with citizens relative to Ballot Issue 2A and noted most voters do not understand the issue. He urged Council to vote on the resolution this evening. COUNCIL COMMENT Mayor Pro Tem Brown explained one of the reasons for Resolution No. 52, is to preserve the redevelopment of the Highway 42 area. He noted the Downtown Business Association passed a motion unanimously opposing Ballot Issue 2A. He announced a project in thE; downtown area, which was recently approved by Council, has been put on hold as a result of Ballot Issue 2A. Council member Marsella stained Ballot Issue 2A proposes to reverse a decision made by Council. She supports the citizen initiative process, but not Ballot Issue 2A. She voiced her disappoir-tment the new downtown project was put on hold. Mayor Sisk voiced his hope both sides of Ballot Issue 2A can be respectful of each other, and felt it would be beneficial for both parties to discuss the issues. MOTION: Mayor Sisk moved to continue Resolution No. 52, Series 2007 to October 2, 2007, seconded by Mayor Pro Tem Brown. All in favor. Absent: Council member Muckle.
