City Council Meeting Minutes October 16, 2007 Page 9 of 15 He noted the north area of Louisville is being developed on both sides of Highway 42 and suggested the street configuration be designed to funnel traffic into the downtown and commercial areas of the City. Mayor Pro Tem Brown voiced concern over asking the developer to reconfigure the streets in the proposal. Planning Director Wood reviewed the street configurations and the traffic patterns and stated the Planning Staff and the Developer will continue to work on the traffic plan. Mayor Sisk voiced his support for Resolution No. 57, Series 2007. MOTION: Mayor Pro Tem Brown moved to approve Resolution No. 57, Series 2007, seconded by Council member Muckle. The motion carried by a vote of 6- 1. Council member Sackett voted no. Mayor Sisk left the meeting at 5:00 p.m. DISCUSSION/DIRECTION ON PROPOSED NOISE ORDINANCE City Manager Fleming reported on a citizen request for the City to adopt regulations to restrict noise deemed excessive and unreasonable. Council member Muckle prepared and submitted a draft noise ordinance, which was reviewed and revised by Staff to make it easier to understand and to enforce. The draft ordinance defines specific levels of noise permitted in the City and includes enforcement provisions. He noted the City already has an ordinance to deal with "disturbing the peace" for those situations where there is noise or conduct disturbances. The draft ordinance requires a citizen to initiate a complaint with the police department. The complainant would be identified and may have to appear in court. He noted there is some overlap between this draft ordinance and the provisions in the existing code. The overlapping and/or potentially conflicting provisions would need to be reconciled if the Council wishes to proceed. He requE:sted discussion and direction on the proposed noise ordinance. PUBLIC COMMENT Pete Clements, 954 W. Alder Street, Louisville, CO supported the ordinance and explained his wife had been quite ill and was disturbed by a neighbor, who started his motorcycle every day at 4:00 a.m. and allowed it to idle between ten and twenty minutes. He coni:acted the police relative to the disturbance, and was told after their investigation, a summons was not warranted. He then sought legal advice to remedy the problem. He urged Council to adopt a modern noise ordinance with clear and objE;ctive standards.
