City Council <br />Meeting Minutes <br />November 5, 2007 <br />Page 7 of 9 <br />MOTION: Mayor Pro Tem Brc-wn moved to approve Resolution No. 58, Series <br />2007, seconded by Council Member Clabots. Roll call vote was taken. The <br />motion carried by a vote of 7-I). <br />ORDINANCE No. 1526, SERIES 2007 - AN ORDINANCE AUTHORIZING THE <br />SALE AND CONVEYANCE ~OF A 1.22 ACRE PARCEL OF LAND OWNED BY <br />THE CITY AND KNOWN AS THE DAMYANOVICH HOMESTEAD PARCEL - <br />2"d Reading -Public Hearing <br />Mayor Sisk requested a City Attorney introduction <br />City Attorney Light read Ordinance No. 1526, Series 2007. <br />Mayor Sisk requested a Staff presentation. <br />Parks and Recreation Director Robson reported the City is the owner of a 1.2- <br />acre parcel of real property located at 7507 Dyer Road and commonly referred to <br />as the Damyanovich HomestE;ad Parcel. The property contains buildings not <br />being used for municipal or governmental purposes. The property was acquired <br />as excess property and a general asset to be sold in order to help defray the cost <br />of the City's acquisition of opE:n space located adjacent to the property. <br />A proposed purchase contract to buy and sell real estate for sale of the property <br />for $490,000 was submitted by John and Julie McKenna. The sale of the <br />homestead parcel and the $200,000 conservation easement payment from <br />Boulder County, will off-set the City's initial cost for the Damyanovich Open <br />Space Property. Based on the original $1,017,500 purchase price, the net cost <br />to the City will be $327,500. Ordinance No. 1526 authorizes the sale. <br />Mayor Sisk opened the public hearing and requested public comment. There <br />were no public comments anti the public hearing was closed. <br />MOTION: Council Member IVluckle moved to approve Ordinance No. 1526, <br />Series 2007, seconded by Council Member Sackett. Roll call vote was taken. <br />The motion carried by a vote Hof 7-0. <br />ORDINANCE No. 1527, SERIES 2007 - AN ORDINANCE GRANTING A NON- <br />EXCLUSIVE FRANCHISE BY THE CITY OF LOUISVILLE TO PUBLIC <br />SERVICE COMPANY OF COLORADO AND ITS LAWFUL SUCCESSORS <br />AND ASSIGNS FOR THE RIGHT TO MAKE REASONABLE USE OF CITY <br />STREETS TO PROVIDE UTILITY SERVICE TO THE CITY AND TO ITS <br />RESIDENTS AND TO ACQUIRE, PURCHASE, CONSTRUCT, INSTALL, <br />LOCATE, MAINTAIN, CIPERATE, AND EXTEND INTO, WITHIN AND <br />THROUGH THE CITY ,ALL COMPANY FACILITIES REASONABLY <br />NECESSARY FOR THE GENERATION, PRODUCTION, MANUFACTURE, <br />
