City Council <br />Meeting Minutes <br />December 4, 2007 <br />Page 6 of 10 <br />• PSCO agrees in the event of any regulatory changes, they will assist the <br />City in modifying the franchise to assure the City receives compensation in <br />the amount of the franchise fees. <br />• PSCO will budget and allocate an annual amount equivalent to 1 % of the <br />preceding year's Electric Gross Revenue for the purpose of <br />undergrounding existing overhead distribution facilities in the City. <br />• PSCO obligation regarding coordination of work, restoration of City <br />property, relocation of Facilities, and reliability of service. <br />• The City reserves the right to engage in the production of utility service to <br />the extent permitted by law. PSCO agrees to negotiate in good faith a <br />long term contract to purchase City generated power made available for <br />sale, including contracirs for rebates, and bill credits. <br />• Regarding the Environment and Conservation, PSCO agrees to provide <br />information and support respecting renewable energy programs. <br />• The Street Lighting and Traffic Signal Lighting Service Agreement provide <br />more detail and specific timeframes for completion of work related to <br />street lights and traffic signals. <br />• Xcel Energy additionallly provides a letter granting the City a right of first <br />purchase on Company property. <br />• A letter regarding projects within the urban renewal area qualifying as a <br />public project as definE~d in the franchise. <br />Craig Eicher, Xcel Energy Representative, stressed this franchise represents a <br />lot of environmentally friendly changes. He outlined Xcel Energy's environmental <br />goals they will propose to the Public Utilities Commission: increase the <br />wind/power portfolio; solar power/thermal storage plant; on-site solar program - <br />SolarAwards; energy efficient programs; retire two older coal fired power plants; <br />and public workshops on energy conservation. <br />PUBLIC COMMENT <br />Doug Grinbergs, 935 W. Sycamore Circle, Louisville, CO read an article from the <br />Sierra Club Magazine, which complimented Xcel Energy for their environment <br />and conservation efforts. He referred to an article in the Cool City campaign, <br />which supports energy efficient traffic lights and street lighting. He addressed <br />Xcel Energy's reliability of service for street lighting and offered suggestions. <br />Annie Hughes, 1405 Garfield Court, Louisville, CO voiced her excitement over <br />the environmental language aidded to the Franchise Agreement. She addressed <br />the agreement and suggested changing the reference of residents to customers. <br />She asked Xcel Energy if tax credits will continue. <br />Mr. Dudley Spitler, Attorney rE;presenting Xcel Energy, addressed the term <br />resident and explained it means each customer.
