City Council <br /> Meeting Minutes <br /> September 3, 2013 <br /> Page 8 of 22 <br /> City Attorney Light read Ordinance No. 1641, Series 2013 and noted there are second <br /> reading amendments. <br /> • <br /> Mayor Muckle opened the public hearing and requested a staff presentation. <br /> Planner I Robinson explained this is a rezoning of a 10.97 acre parcel located on the <br /> corner of South Boulder Road and Highway 42, known as the Coal Creek Station. The <br /> • City Council approved a preliminary plat and preliminary planned unit development <br /> (PUD) for the property on July 2, 2013. As part of this process, the applicant requested <br /> and City Council approved modifications to the adopted Land Use Plan. The City <br /> Council approved a modification to the Land Use Plan on July 16, 2013. The applicant <br /> now requests a rezoning of the property to match the approved Land Use Plan. <br /> The property is located within the Highway 42 Revitalization Area and must be rezoned <br /> in accordance with Chapter 17.14 in the LMC with a combination of Mixed-Use <br /> Residential (MU-R), Residential Medium Density (RM), and Mixed Use Commercial <br /> Community (CC) zone districts. The proposed rezoning complies with the Land Use <br /> Plan. <br /> The Planning Commission held a public hearing on August 8, 2013 to consider the <br /> applicant's proposal, and passed a resolution recommending approval of the zoning <br /> change by a 6-0 vote. Staff recommended the City Council approve Ordinance No. <br /> 1641, Series 2013 on second and final reading. <br /> • COUNCIL COMMENT <br /> Council member Jasiak reported on comments from residents, who have concerns over <br /> the development. She voiced her appreciation for the developer asking for less <br /> development and density. She felt it would be a good development for the area. <br /> Mayor Muckle called for public comment and hearing none, closed the public hearing. <br /> Mayor Muckle concurred with Council member Jasiak's comments and voiced his <br /> appreciation for the lower density proposed. <br /> MOTION: Council member Sackett moved to approve Ordinance No. 1642, Series <br /> 2013, as amended, on final reading, seconded by Mayor Pro Tem Dalton. Roll call <br /> vote was taken.
