Powers. <br /> The municipal judge shall have the power to issue local rules of operation or <br /> procedure consistent with any rules of procedure adopted by the state supreme court. <br /> The municipal judge shall have all powers incident to a court of record in relation to <br /> the attendance of witnesses, the punishment of contempt, and to enforcing the orders <br /> of court; provided, that no imprisonment for contempt shall exceed five-days six <br /> months and no fine for such case shall exceed$44000$1,000.00. <br /> Section 3. Section 5.18.290 of the Louisville Municipal Code is hereby amended to <br /> read as follows (words added are underlined; words deleted are strn,ckemthrough): <br /> Sec. 5.18.290. Suspension or revocation hearing. <br /> A. A manager shall be entitled to a hearing before the licensing officer <br /> Municipal Judge if the city seeks to suspend or revoke the manager's license based <br /> on a violation of this chapter or any other section of this Code regulating sexually <br /> oriented businesses. The manager may continue to manage a sexually oriented <br /> business during the hearing process. <br /> B. When there is probable cause to believe that a cause for suspension <br /> or revocation exists, the city attorney may file a written complaint with the licensing <br /> officer Municipal Judge setting forth the circumstances of the alleged violation. <br /> C. The f cer Municipal Judge shall provide a copy of the <br /> complaint to the licensee, together with notice to appear before the Wising-per <br /> Municipal Judge for the purpose of a hearing on a specified date to show cause why <br /> the licensee's license should not be suspended or revoked. <br /> D. At the hearing, the Municipal Judge shall hear such <br /> statements and consider such evidence as the police department or other <br /> enforcement officers, the owner, employer, occupant, lessee, or other party in <br /> interest, or any other witness shall offer which is relevant to the violation alleged in <br /> the complaint. The eer Municipal Judge shall make findings of fact <br /> from the statements and evidence offered as to whether the violation occurred in or <br /> near the licensed establishment. If the licensing officer Municipal Judge determines <br /> that a cause for suspension or revocation exists, he or she shall issue an order <br /> suspending or revoking the manager's license within 30 days after the hearing is <br /> concluded based on the findings of fact.
