E. The order of the licensing officer Municipal Judge made pursuant to <br /> subsection D above shall be a final decision and may be appealed to the district court <br /> pursuant to Colorado Rules of Civil Procedure I06(A)(4). Failure of a licensee to <br /> timely appeal said order constitutes a waiver by him or her of any right he or she <br /> may otherwise have to contest the suspension or revocation of the manager's license. <br /> F. The licensing officer Municipal Judge shall have the power to <br /> administer oaths, issue subpoenas, and when necessary grant continuances. <br /> Subpoenas may be issued to require the presence of persons and production of <br /> papers, books, and records necessary to the determination of any hearing which the <br /> licensing officer Municipal Judge conducts. It is unlawful for any person to fail to <br /> comply with any subpoena issued by the i er Municipal Judge. A <br /> subpoena shall be served in the same manner as a subpoena issued by the district <br /> court of the State of Colorado. <br /> G. All hearings held before the licensing officer Municipal Judge <br /> regarding suspension or revocation of a manager's license issued under this <br /> ordinance shall be recorded stenographically or by electronic recording device. Any <br /> person requesting a transcript of such record shall post a deposit in the amount <br /> required by the licensing officer Municipal Judge, and shall pay all costs of <br /> preparing such record. <br /> H. In the event of suspension, revocation, or cessation of business, no <br /> portion of the manager's license fee shall be refunded. <br /> Section 4. Subsection E of Section 8.12.200 of the Louisville Municipal Code is hereby <br /> amended to read as follows(words added are underlined; words deleted are stricken through): <br /> Sec. 8.12.200. Arborist license required <br /> E. Q fenses. Each tree pruned or otherwise modified in violation of <br /> this section shall constitute a separate offense. The first such offense will result in <br /> a written warning from a code enforcement officer upon notification by the city <br /> forester. The second offense may result in a summons issued by the City of <br /> Louisville Municipal Court and is punishable by a fine not to exceed $500.00; <br /> each subsequent offense thereafter may result in a summons issued by the City of <br /> Louisville Municipal Court and is punishable by a fine not to exceed $4,000.00 <br /> the maximum fine set forth in section 1.28.010.A of this Code. There will be a <br /> 11I 11 .. <br /> Section 5.
