construction drawings, including all appurtenances, for the Point of Connection shall also <br /> be submitted to Louisville for its review and approval. Louisville shall approve or <br /> disapprove such drawings within forty-five (45) days after its receipt thereof. Any <br /> disapproval shall not be unreasonable and shall include the reasons therefore. Lafayette <br /> shall notify Louisville ten (10) days prior to the initiation of construction of the Point of <br /> Connection, including appurtenances. Louisville will have the right to inspect construction <br /> of the Point of Connection to insure that the work is in general conformance with the <br /> approved construction drawings. In the event Louisville finds any non-conformance with <br /> the approved construction drawings in the construction of the Point of Connection, <br /> Louisville shall notify Lafayette in writing and Lafayette will correct said deficiencies within <br /> a reasonable period of time. The Point of Connection shall not be placed into operation <br /> until such time as all of said deficiencies are corrected. The installation of the Point of <br /> Connection shall be completed by Lafayette on or before June 1, 1994. <br /> 3. Mutual Aid. The Point of Connection shall be capable of conveying <br /> Lafayette's treated water to Louisville as well as Louisville's treated water to Lafayette. <br /> Therefore, Lafayette agrees to design, construct and maintain the Point of Connection in <br /> a manner such that emergency'service could be provided from one party to another in <br /> times of failure of the other's water treatment facilities. Use of the Point of Connection <br /> for emergency water service from one party to the other shall only be done with the mutual <br /> consent of both communities. The cost to modify the Point of Connection from its <br /> configuration, as referenced under this agreement, to that of a standby mode for emergency <br /> service from one party to the other shall be borne by Lafayette. The cost of maintenance <br /> and repair of the Point of Connection shall be born equally by Lafayette and Louisville <br /> following the termination of this agreement pursuant to Paragraph 10. This Paragraph 3 <br /> shall remain in effect notwithstanding the termination of this agreement pursuant to <br /> Paragraph 10, but either party may terminate this mutual aid paragraph and discontinue <br /> maintenance of the Point of Connection at any time following termination of this <br /> agreement pursuant to Paragraph 10 by providing written notice to the other. <br /> 4. Payment. Lafayette shall pay on or before May 1 of each year the amounts <br /> as identified in the table below. Payment shall represent the amounts of treatment <br /> identified in the table for the year so noted. The minimum lease payment shall be made <br /> 3 <br />
