Reservation of Capacity, Treatment and Delivery. Louisville shall treat in its <br /> treatment plant(s) and convey in its water lines the quantities of water identified in the <br /> table set out in Paragraph 4 up to the agreed upon rates and deliver to the Point of <br /> Connection the water provided pursuant to Paragraph 1 herein by Lafayette. If Louisville's <br /> treatment or delivery capacity is reduced due to a failure of its treatment plants or water <br /> lines and the failure causes its treatment or conveyance capacity to be less than that <br /> required by Louisville and that being utilized by Lafayette per the table in Paragraph 4, <br /> Louisville and Lafayette shall reduce demands proportionally. By way of example, if <br /> Louisville's demand was 9 mgd and Lafayette's demand was 1 mgd, and Louisville's water <br /> treatment or conveyance capacity was reduced to 8 mgd, Lafayette would be entitled to .8 <br /> mgd, one tenth of the reduced capacity, and Louisville would be entitled to 7.2 mgd, nine <br /> tenths of the reduced capacity. If in the future Louisville should agree to treat water for <br /> other third parties such capacity will be treated as a Louisville water demand for the <br /> purpose on assigning reduced capacity. <br /> 6. Surface Water Storage and Conveyance. Louisville will utilize its best effort <br /> to assist in conveying Lafayette water by other means should the delivery capacity of the <br /> 4 <br />
