Special Meeting Minutes <br />October 8, 2013 <br />Page 7 of 12 <br />City Manager Fleming addressed Mr. MenakerCongressman Polis did <br />not do an art show in the recreation center lobby because of the fee. City Manager <br />Fleming stated it was a scheduling problem rather than an issue of the fee. With <br />trainers at the Recreation Center, he <br />explained the City is complying with the Fair Labor Standards Act.He requested <br />fees for the lobby. <br />Human Resources Director Hix explained the City surveyed other recreation centers <br />relative to personal trainers and implemented the same fees. The personal trainers are <br />paid a wage and part of the wage is paid to the recreation center because they are <br />Recreation/Senior Center Superintendent Martin explained changes are proposed for <br />January 2014. She explained multiple personal trainers use the recreation center to <br />train clients. There are requirements for personal trainers such as insurance and <br />certifications. They pay daily admission for themselves and for their client. Although the <br />industry standard is for the trainers to be on staff, the City has chosen to implement a <br />bench fee, which is a $20.00 per unduplicated client per month. She stated there are <br />about eleven personal trainers who use the recreation center to run their businesses <br />and pay a daily admission fee. <br />Council member Jasiak inquired if the recreation has received any feedback from <br />residents who cannot access a particular piece of equipment because it is being used <br />by a personal trainer. Recreation/Senior Center Superintendent Martin stated there are <br />complaints seasonally, especially in the January timeframe or the busy time of day; 9:00 <br />a.m. or 5:00 p.m. <br />Council member Jasiak noted the City must compete with new recreational facilities and <br />suggested a conversation on whether the focus should be the asset of the residents <br />being able to use the recreation center or whether the asset is the personal trainers. <br />Michael Menaker, 1827 Choke Cherry Drive, Louisville, CO explained the trainers are <br />not using the equipment; the dues paying members are using the equipment. He noted <br />a $20.00 fee is not reasonable because the trainers are providing a benefit to the City. <br />He stated if the fees are too high, it will create a negative economic effect. He noted <br />most of the trainers teach popular classes, which brings more visitors to the Recreation <br />Center. Human Resources Director Hix explained there is a Fair Labor Standard Law, <br />which prohibits a contract personal trainer from being an employee. It is prohibited by <br />law to teach a class and be a personal trainer. <br />Mayor Muckle felt the City should do a Historic Preservation Master Plan and allow the <br />Plan to determine the staffing needs. He felt the Historic Preservation Fund should pay <br />for the Master Plan.Mayor Pro Tem Dalton concurred. He requested the Planning <br />Director provide information on the position and what he feels will be accomplished. <br />28 <br />
