<br />ORDINANCE NO. 1118 <br />SERIES 1993 <br /> <br />AN ORDINANCE SUBMITTING TO THE REGISTERED ELECTORS OF THE <br />CITY OF LOUISVILLE, COLORADO, AN ADVISORY QUESTION OF <br />WHETHER THE CITY COUNCIL SHOULD ADOPT A SCHOOL IMPACT FEE <br />APPLICABLE TO NEW RESIDENTIAL DWELLING UNITS IN THE CITY. <br /> <br />WHEREAS, the increased rate of residential and commercial <br />development within the Boulder Valley School District RE-2 over the <br />past several years has caused significant growth in the School <br />District's student enrollment in Louisville and throughout the <br />District which condition is projected to continue into the future; <br />and <br /> <br />WHEREAS, new residences place significant new demands on the <br />School District to provide new school facilities or to expand <br />existing facilities for the education of the children residing <br />within those residences; and <br /> <br />WHEREAS, the enrollment has <br />capaci ty at many of the School <br />schools located within Louisville, <br />more severe shortages in space in <br />and <br /> <br />already exceeded the designed <br />District's schools, including <br />and is projected to create even <br />the ensuing five to ten years; <br /> <br />WHEREAS, the Board of Education of the School District <br />believes that, in order to promote and protect the public health, <br />safety, and welfare, and accommodate the needs created by new <br />development, the School District must expand its educational <br />facilities in order to maintain current and acceptable levels of <br />educational service to its students; and <br /> <br />WHEREAS, the Board of Education believes that the regulation <br />of residential development may require the imposition of a fee to <br />defray at least in part the costs of new or expanded school <br />facilities made necessary by new residences; and <br /> <br />WHEREAS, the Board of Education has adopted a School Impact <br />Fees Methodoloqy recently recommended by a Task Force of Local <br />Government Representatives and has officially requested that the <br />City of Louisville, along with Boulder County and other <br />municipalities with the school district, impose school impact fees <br />generally consistent with the School Impact Fees Methodoloqy, but <br />deferring the secondary school cost component of the fee during the <br />first year of implementation of the School Impact Fees Methodology; <br />and <br /> <br />1 <br />
