e, The School District must agree to and must pay all costs, including but not limited to attorney fees, judgments, settlements, and court costs, for any legal actions related to Louisville I s adoption or enforcement of the school impact fee, f, Any credits against the school impact fee must include consideration of land dedication of developers and/or landowners for land acceptable to the School District and the City. g, While voter approval of a school impact fee is not legally required, a majority of the registered electors voting on the question at the November 2, 1993 regular election of the City of Louisville must vote in favor of an advisory question to appear on the ballot as described in Section 2 of this Ordinance, h. The foregoing conditions are subject to further negotiation with the Board of Education of the School District. Section 2. The following advisory question shall appear on the ballot at the November 2, 1993, regular election of the City of Louisville, Colorado: SHALL A SCHOOL IMPACT FEE APPLICABLE TO NEW RESIDENTIAL DWELLING UNITS, EFFECTIVE NO SOONER THAN JANUARY 1, 1994, BE ADOPTED BY THE LOUISVILLE CITY COUNCIL, IF THE CONDITIONS DESCRIBED IN CITY OF LOUISVILLE ORDINANCE NO, 1118 AND SUCH OTHER CONDITIONS AS THE CITY COUNCIL MAY DECIDE ARE NECESSARY OR APPROPRIATE ARE MET? YES 0 NO 0 Section 3. The City Council herewith finds, determines, and declares that this Ordinance is necessary for the immediate preservation of the public health and safety in order to permit the foregoing ballot question to appear on the November 2, 1993 regular City election ballot, and this ordinance shall take effect upon adoption and signing by the Mayor if approved by three-fourths of the members of the City Council.
